EPA wants to use the Clean Air Act to regulate CO2, but cherry-picks the provisions so as not to have to regulate CO2 down to the level of every home owner.  It also wants every state to sign on to its interpretation or risk the EPA taking over the state's permitting rules.

Texas responds by citing the CAA's provisions and requirements and beats the EPA about the head with them.  EPA knows that if it must apply the CAA in total, it will be overruled by Congress in a NY minute, as it would bring the economy to a grinding halt, requiring the permitting of pretty much every new building or activity, explicitly.  EPA also knows that Congress didn't authorize such an EPA power grab and wants the states to sign on quick-like to its novel interpretation of the CAA.

Why can't we replace all current public servants with ones of this quality?

Speaking of the Law of Unintended Consequences (of which we weren't speaking, until I mentioned it) ... Obama may turn out to be a blessing in disguise. His loyal and overzealous minions may just get so many states knackered that the states collectively start to reassert their sovereignty under the Constitution, thus reversing recent (and not-so-recent) trends and perhaps getting the country a little closer to getting back on track.

Wouldn't that be nice?
