Can judges throw cases out simply based on that fact that they are a complete waste of the courts time?

1st amendment issue, clearly.  Those things are no worse than the profanity bumperstickers or the Calvin peeing on ChevyFordHonda stickers.

Why would they do that?  How would lawyers make any money that way?

From the way the law is described, the prosecutor will have to argue that the truck's dangly bits represent "parts of the human body."  [Emphasis mine.]  Getting a live bull into the courtroom won't too difficult, but who will drop trou' for the human side of the comparison?

Since the law is unconstitutional, I'd vote to dismiss the case in order to save the taxpayer's money that would be used to defend it.

Oh?  I have a reasonable doubt about that "human" in the law applying to any of the decorations I have seen.  How do you meet the burden of proof?

Don't worry, I have tough time getting past voir dire and certainly wouldn't be sitting on that jury even if I were in the pool.

Only if the item in question was specifically made to resemble human genetalia.  In the case of Truck Nutz (or any of the other like products) they are modeled on bovine genetalia.  As tacky or tasteless as it might be, that does not meet the criteria for ticketing under the quoted law.

To answer a couple of questions posed by earlier posts...
1.  Can a judge throw a case out for being a waste of time?  Yes, but a smart judge lets the case be decided by a jury, then tells them that it's the prosecutor's fault.  Makes for an informed electorate who puts the blame where it belongs.  Also, if a judge dismisses prior to trial, jeopardy doesn't attach, so the prosecutor can keep filing the charge again and again.
2.  Grand jury?  No grand jury for traffic tickets or misdemeanor offenses.  Charges filed by either the officer or the prosecutor, depending on the jurisdiction.  In Ohio, this would have been filed by the officer, but the prosecutor would decide if it proceeds or not.
3.  Waste of time?  I would love this case.  All of the First Amendment issues, the obscenity laws.  this is good stuff, not the typical boring assault cases of who hit who first during the drunken brwal at the Double Duece.
