Fed program requiring uncompensated crop set-aside ruled a Constitutional violation.

Surprising almost-unanimous 8-1 vote. Dissenter was Sotomeyor who wrote that because the program only seizes part of the crop it does not constitute a violation. ;/

That's been a big thing locally. Glad to see this resolution.  I wonder if Sotomeyer's picture is next to the definition of "the law is an ass" in the dictionary?

So as long as the .gov leaves the farmer one raisin, it's legal in Sotomeyor's eyes?

It seemed to be the logical conclusion of the her argument.

And . . . what brimic said.  There is no point in debating people of the "collective good > individual rights" mindset, even thought said mindset flies in the face of the Constitution.

If we leave you 1% of your crop you still have the right to sell that, so the government has no obligation to compensate you for the 99% we took. Perfectly sensible. ;/ :facepalm:

I thought she was talking about also considering other property rights separate from crops.  I wasn't sure how that worked.
