Fed program requiring uncompensated crop set-aside ruled a Constitutional violation.

Surprising almost-unanimous 8-1 vote. Dissenter was Sotomeyor who wrote that because the program only seizes part of the crop it does not constitute a violation. ;/

That's been a big thing locally. Glad to see this resolution.  I wonder if Sotomeyer's picture is next to the definition of "the law is an ass" in the dictionary?

Justice Clarence Thomas added a pun in a concurring opinion, noting that if the government was not taking raisins for an actual “public use,” then calculating their value would be a “fruitless exercise.”

If we leave you 1% of your crop you still have the right to sell that, so the government has no obligation to compensate you for the 99% we took. Perfectly sensible. ;/ :facepalm:

I thought she was talking about also considering other property rights separate from crops.  I wasn't sure how that worked.
