Title: Mothers Against Teen Violence bring lawsuit against 18 yr old man who wants ccw
Post by: gunsmith on December 03, 2010, 03:09:40 PM
Mothers Against Teen Violence  probably are fine with 17 yr old machinegun users in the Army however.

This is the Texas lawsuit for ccw rights.

I don't understand how they have any legal standing to be allowed into the suit at all. They aren't the defendants -- how can they move to dismiss?

Calling Bridgewalker and Ned Hamford ...

I, too, wonder at how they can claim standing to intervene via a motion to dismiss.

Submit amici briefs till the court runs out of storage space?  Sure.

I'm familiar with the theory that says that a person, organization, or members of an organization that are also effected by the cause of the petitioner can ask to become co-plaintiffs, but I never heard/saw that granted to someone seeking to become a co-defendant.  (using very basic concepts to try to explain, not actual legal theory)

Impatiently awaiting the learned responses of our resident legal eagels.

stay safe.

Even if we accept the legal fiction that a man is a child all the way until the magical age of 18, the idea that men aged 18 are children is not merely hilarious, but morally obscene.  We have now the idea that a man can be trusted to own a car - which is a weapon - to own a firearm - to be legally responsible for whatever violation he commits with these - but cannot be trusted to carry the same firearm outside his home. This same man can be drafted, in a national emergency, or can enlist to serve his country. He can vote to appoint men who direct foreign and domestic policy. And yet,  these fools wish us to pretend this man, too, is a child?

"However, the two activist groups asked permission to temporarily withdraw their court motion until state officials first have the chance to respond. "

I imagine the lawyers representing the two activist groups are either true believers or amoral capitalists.  For the first, I doubt the competence, for the second I do envision 'sure I'll draft up something at the usual rate.'

I think any court clerk will accept any paper, even if its just so the judge can then yell at the person and then initiate ethics charges with the relevant bar.

They are just looking for press.  They withdrew the motions because they know they don't have standing.

Anything to try and drum up some cash and, mostly, pretend they are still relevent.

But-but, they are concerned mothers! This obviously makes them intrinsically involved and grants them the wisdom to infallibly know the correct course of action here, besides... it's for the children!!

These two combined make the most since.  IANAL, but I don't see how they would have any standing in the case except for filing amicus briefs.

I made a post on a new article talking about this basically asking that, if 18 y.o.'s don't have the same rights as adults, then why does our nation send children to fight our wars? Texas needs to make a decision....18 or 21....

It says in part, "As a result of the danger posed to the public when such young persons are armed with lethal firearms outside the home, most states, like Texas, prohibit persons under 21 from carrying loaded, concealed weapons in public."
I also seriously doubt they have any evidence that shows armed 18 year olds do in fact pose a danger to the public as they have stated.

They'll likely just drag out the numbers for drug dealers and gang bangers aged 17-20 who acquired their firearms illicitly to begin with. It seems to be a recurring theme with the gun-grabbing hoplophobes to count people in those categories as "gun related child deaths."

Just read this article, I expected it to be anti-slanted but maybe we should look at the person behind the lawsuit. If what they quote from his facebook wall is accurate, he sounds . . . unstable at best.

"There is no redemption, There is no forgiveness. I will stare into your eyes as I pull the trigger and laugh as you hit the ground with your last, pathetic breath."

I think context is everything.  If it did anything but eliminate the impact of their hack job article, they would have included it. Ignoring context, how fairs everything you've said in your entire life?  Especially things you've simply quoted.  And how about every Halloween costume you've ever worn?  [Unless you think this kid dresses up like a gangster with a tommy gun when walking about day to day.]  Every book you've read, or video game you've played.  Take away common sense and context, a pretty damning picture can be drawn for anyone.

"There is no redemption, There is no forgiveness. I will stare into your eyes as I pull the trigger and laugh as you hit the ground with your last, pathetic breath."

Can't say I like the laughing, but it does seem a message of judgment.  Directed at a roommate or ex gf = oh noes, but if directed at some socialist abstraction ala some of the later parts of the Sword of Truth objectivist themed book series, not so worrysome.

Context is King

The CHL law is that way because it mirrors the 18/rifle, 21/handgun dealer-purchase fed law.  It was a matter of political expedience.
