Title: ATF: No guns or ammo for medical marijuana users

TL;DR: An open letter to all FFLs stating that medical marijuana users are prohibited possessors, and that you should not sell them guns nor ammo if you have cause to believe that they are using medical MJ.

More hypocrisy from the agency that uses your tax money to supply criminals with guns.

I knew that was coming.


Next up:  No guns for people with prescriptions for Vicodin, Percocet, Oxycodone, etc.  And a push for ATF to have access to your medical records.

I remember MillCreek giving me a ration over the fact that I pointed out that some Electronic Health Records application suites actually have information-gathering templates for interviewing a patient to see if they have firearms in the household.

With:
-dotguv in your medical records, and;
-ATF wanting to restrict firearms rights to anyone on a prescribed drug...

Where do YOU think they're going to go next?  And what resources will they use to get there?

It doesn't mean much.  They haven't created any new laws or regs here.

MMJ users are going to continue to not check the box that says they are using or addicted to a controlled substance, and gun shops are going to continue to not ask

what was the cause for this?  was there a rash of mmj users suddenly wreaking havoc?   (damn, we need more cheetos....hand me the .45?)

That's a REAL bad precedent.  If they hammer on legit MM users, then they might decide to go after people on other prescriptions.  The last thing we need is the govt. finding reasons to arbitrarily deny people permission to own guns.

substance?

This question has been on the ATF Form 4473 for many, many years.  So the ATF has been asking about, and denying firearms ownership based on drug use for quite a while now.  I have read of with people who have been denied because they answered this question affirmatively, based on their use of narcotics for chronic pain, for example.

So don't ask their opinion.  Buy your guns face-to-face from a private seller in your state.

I have actually spoken with some people who have done this, in the context of my job.  They put 'yes' in the box for generally two reasons: they were confused about having a prescription and thought they still needed to say 'yes', or they were obtaining narcotics off the street and therefore said 'yes'. 

To my chagrin, I have discovered that a certain percentage of patients we are treating for chronic pain do end up either getting supplemental meds off the street, or they are selling their meds that we prescribe.  This is why all of our chronic pain patients sign pain contracts that provide for no-notice toxicology tests.  If it turns out that you are taking meds other than those prescribed, or the meds that we prescribe are not in your system after you said that you take them faithfully, we will be having a conversation about continued prescribing for you.

I have a prescription for marijuana pills (marinol) which I was taking to improve my appetite after surgery ... I don't see any danger in being armed while taking them ... no matter how bad I get the munchies, I'm not going to point a weapon at someone and demand that they hand over a twinkie.

Federal agencies and departments have been doing this for the past few years.  I doubt there was anything specific that brought this on.  I would guess that it is just the feds saying that they are going to enforce federal drug laws no matter if the states wan't to legalize some drugs.

The insurgents have been getting all uppity lately about that 10th amendment thing.
