Federal judge strikes down Obamacare
« on: January 31, 2011, 06:12:45 PM »
A federal judge today declared that Obamacare's requirement for everyone to buy insurance is unconstitutional. He went further than the last two courts, though, by saying that the requirement rendered the entire law unconstitutional.

This is going to make for a great SC watch.

It is much more powerful to seek Truth for one's self.  Seeing and hearing that others seem to have found it can be a motivation.  With me, I was drawn because of much error and bad judgment on my part. Confronting one's own errors and bad judgment is a very life altering situation.  Confronting the errors and bad judgment of others is usually hypocrisy.

Huzzah!

Stoopid power-hungry dems left themselves without a severability clause.

They did that because every little splinter group in the democRAT party wanted to be sure that their pet clause wouldn't be thrown out.
Trump won in 2016. Democrats haven't been so offended since Republicans came along and freed their slaves.

I don't think I've ever seen a bill without a severability clause. Hard to imagine splinter groups wanting all or nothing, but I suppose it's possible.

In Missouri a few years back, we finally got concealed carry through the legislature. We figured that there would be some give and take and bargaining. Nope. The governor vetoed it. So it went back for a 2/3 vote, and got it.

In whole.

Which meant instant reciprocity, including nonresidents, for every other state's permits, etc... Missouri went from "A" Brady status to "F" overnight!

Any word from The Bamster on whether his administration will abide by the court decision?

I know nicknames are off-limits for policritters here, but I do like the "Bamster."  I think "Bam-Bam" might be a good one to start spreading around, too. =D

Okay while funny, lets get back on track.  Nicknames are against forum rules and not in the spirit of honest discussion.

So what happens if/when Obama decides not to obey the court order and pushes ahead with his law?  A constitutional crisis, no?

What then?

I wonder how many SS officers would gladly serve that warrant...  >:D

There are other forces at work in this world, Frodo, besides the will of evil. Bilbo was meant to find the Ring. In which case, you also were meant to have it. And that is an encouraging thought

If SCOTUS rules that the law is unconstitutional, will the taxes (if any  ;/) that get collected be returned to the tax payers or will the .gov just keep it as a gift?

I assume they'll just keep it.  The law isn't technically unconstitutional until the courts say so, and the law is still legally in force until it's struck down.

Between the 26 states represented in the FL suit and the others in the Virigina (and other suits), I think there are enough to pass a constitutional amendment......

Mark Levin's 1-31-11 show goes into detail of the decision and Obama's government's response.  Short story is since the court enjoined fed.gov from proceeding, a meeting should be called between the plaintiffs and Secty of HHS to discuss only one topic:  Will HHS continue implementation (something Obama said will happen).  If HHS says it will continue the next step is to go back to the judge and seek contempt.  Be still my heart.

Why would the HHS secretary even consider attending such a meeting if their intent is to proceed with the law?
