A New Orleans man is suing the city and its district attorney for refusing to give back a gun that police seized when he was arrested on drug and firearms charges.

The American Civil Liberties Union on Thursday filed the federal suit on behalf of Errol Houston Jr., who was arrested last year following a traffic stop.

The suit says the district attorney's office declined to prosecute Houston but has refused to return his .40 caliber firearm.

Houston claims Orleans Parish District Attorney Leon Cannizzaro has instituted a policy that firearms seized during arrests will not be returned to their owners.

The ACLU says that policy violates Houston's constitutional rights.

Cannizzaro says his office decides on a "case by case basis'' whether to return confiscated guns.

Does this indicate a fundamental shift in the ACLU's policy with respect to guns?  I doubt it, and I suspect that they're doing this for some other reason.  But for them to come out and say that the police taking the gun of an individual, and not returning it to that individual, violates that individual's rights certainly seems to be an orthogonal shift from their usual "collective right, that's why the police have guns" reasoning.

Interesting, none the less.

How the heck could they justify not returning a person's property when they're released?  I've never been arrested, but I thought they bagged up everything upon your arrest/booking and returned everything (minus anything illegal or evidence collected for a trial) when you were released?

Maybe one of the officers liked it, and figured it would fill a hole in his collection?

DINGDINGDING !!!  We have a winner.   It could have been his Car, Boat, Home, Bicycle, Wheelchair, Shoes, Clothes, Books, Porno, etc.  I have to agree with the ACLU on this.  Arrested and not convicted = anything and everything seized gets returned with a nice apology.  Bar None.
Some days even my lucky rocketship underpants won't help.

Heh, I only court ladies.  They tend to be attractive, intelligent, well armed and exceedingly crazy.  I will grant you, "strange" does not begin to cover my relationships. 

Anything positive re guns, you mean.  They have joined forces with the NRA on side projects in the past, such campaign contributions and such.  I'm not a fan of the ACLU completely, but I will grant that they have done some good work in the past.

Actually, you don't need to be arrested to have your stuff confiscated.  That's why you occassionally see odd court names like "United Staes vs $10,000".

I am not a lawyer, so please don't take my word for this in any way, shape or form.  Ask a lawyer, not me.  A lawyer tried explaining it to me, but it hurt my brain.  But let's say the police find a lump of cash on you through legitimate means.  The police ask you to prove you got it legally.  You can't.  So they arrest the cash.  To get it back, you have to sue, prove you have standing (I have no clue what's involved in that), prove it was not obtained illegally, etc.  It's not "guilty until proven innocent" because you are not on trial.  The money or other objects are.

they have a sense of humour  they once defended a guy who burned a cross on his own property.  they sent a black lawyer who won the case
It is much more powerful to seek Truth for one's self.  Seeing and hearing that others seem to have found it can be a motivation.  With me, I was drawn because of much error and bad judgment on my part. Confronting one's own errors and bad judgment is a very life altering situation.  Confronting the errors and bad judgment of others is usually hypocrisy.
