I have to agree with the ACLU on this. Arrested and not convicted = anything and everything seized gets returned with a nice apology. Bar None.
Actually, you don't need to be arrested to have your stuff confiscated. That's why you occassionally see odd court names like "United Staes vs $10,000".
I am not a lawyer, so please don't take my word for this in any way, shape or form. Ask a lawyer, not me. A lawyer tried explaining it to me, but it hurt my brain. But let's say the police find a lump of cash on you through legitimate means. The police ask you to prove you got it legally. You can't. So they arrest the cash. To get it back, you have to sue, prove you have standing (I have no clue what's involved in that), prove it was not obtained illegally, etc. It's not "guilty until proven innocent" because you are not on trial. The money or other objects are.
