https://mainstreetgazette.com/federal-judge-upholds-liability-immunity-law-for-glock/U.S. District Court Judge Susan Brnovich shot down the lawsuit, which was filed on behalf of Carlos Travieso Jr. by the Brady Campaign to Prevent Gun Violence, an extreme anti-gun group.
In 2018, Travieso Jr. was riding in a vehicle with others when a teenager in the car discovered a 9mm Glock handgun. The teen reportedly assumed that the pistol was safe to handle given that it didn’t have a magazine in it at the time, not realizing that a round was in the chamber when she pulled the trigger and shot Travieso Jr, which resulted in a paralyzing injury.
The anti-gun Brady group filed suit against Glock, charging that the company failed to protect the teen from accidental discharge as there was no obvious warning indicator that a live round was chambered in the pistol. It should be noted that the pistol did, in fact, have an indicator that a round was chambered, but the Brady group said the pistol was defective due to a lack of other warnings or safety measures to make it obvious that it contained a live round.
I am glad the Judge upheld the law. I wish it could be thrown out just on the facts seeing that last statement. IMO, it would be like someone suing Toyota for lack of a backup camera when the car did in fact have a backup camera.
