Meh. What's the time of death? Maybe he woke up at 7 am, and there was too much light getting in through the curtains, or somebody was making a lot of noise in the next room.

It said the body was cold, and I think it was implied rigor had started.  So he probably died shortly after going to bed.

Pillow could be that he was sitting up in bed with the pillow propped up against the headboard, had the heart attack and laid down in hopes he'd feel better.  Pillow fell over him after he died.

I can certainly get tinfoily at time, but in this case I rather doubt it was anything but natural.  If Obama (or hangar on) wanted to bump off Scalia now is a bad time to try.  Not the worst time to try, but very far from the best.  Had this happened when the Dems still had their Senate majority I'd be a LOT more suspicious.  Or even just a few months ago when there was still more than a year to the election and it would have been a lot harder for the Reps to argue to wait until the new POTUS was sworn in.

According to the article, Ginsberg is 83, Kennedy is 79, and Breyer is 76. So there may be some (slim) hope that a Republican president might repair the damage done by whomever the O selects. Though I could also imagine all three of those stepping down, if a Republican is elected, allowing a lame duck Obama to nominate their replacements. The Left doesn't play around anymore.



I would think that no one would step down after the elections.  The court comes out of recess the first Monday of October, best hope is that the court doesn't take on any cases while there is an open seat(s) on the bench.

Who even says it has to be nine justices? Forget approving whoever Obama wants or not, as I recall congress is well within it's rights to hold the number wherever it wants and tell POTUS to FOAD.

Sort of. The President can actually put as many justices as he likes on the Supreme court. FDR threatened to do exactly that. Of course congress has to approve them.

This is not my understanding, and the number set to nine was part of the Judiciary Act of 1869, and FDR's plan failed because congress wouldn't change it.

I thought FDR was upset the SC was throwing out some of his socialist New Deal laws.  He had a majority in Congress.

Wickard v Filburn.  The Commerce Clause can mean anything, and the rest of the Constitution, nothing.
