Title: Justice Kennedy announces his retirement
Post by: DustinD on June 27, 2018, 02:12:28 PM
All of the news sources are saying Kennedy will retire. This should make midterms even more interesting.

https://www.nytimes.com/2018/06/27/us/politics/anthony-kennedy-retire-supreme-court.html

NYT even mentions this could affect gun rights.

That will be very interesting. Especially given Ginsburg's age. I'm thinking she's holding off on retirement because, Trump. If he gets a second term though,  I don't think she'll last through it even if she wants to.

Maybe Kennedy's retirement will cause her to throw in the towel too, or like you said retire a day after the 2020 election.

Mine is an evil laugh.

So will the Republicans hurry up and appoint a replacement before the election, or use this issue to boost GOP turn-out?

Another article:

https://www.cnbc.com/2018/06/27/anthony-kennedy-retiring-from-supreme-court.html

But his retirement isn't until July. Trump is going to have to move fast to put in a replacement before this congress is done and the next crew takes office in January. This just points up why it's going to be important for us to hold our noses and vote for whoever supports Trump, regardless of other thoughts, views, or feelings.

I only wish Bader-Ginsberg had announced her retirement, but I think she'll stay until she drops dead on the bench rather than allow trump to name her successor.

It better be the former, because you KNOW for the Democrats it will be the latter.

Quote from:  New York Times article
The bitter 14-month battle over Justice Scalia’s seat, during which Republican senators refused to consider President Barack Obama’s nomination of Judge Merrick B. Garland, will most likely pale in comparison to the coming fight over Justice Kennedy’s seat.

I suspect that's the most truthful statement the NYT has printed in a good long while.

Glorious. First off the BBC calls him a conservative and then goes on to talk about two important LGBT decisions that he led in their favor. So are all conservatives Hitler, or was he not a conservative, or thank you.

Second, the radleft is like a dog on his last bit of energy chasing cars in a busy parking lot. Oh look trump! Throw the ball, trump, throw the ball! Oh he threw it!!!! Chase, chase, chase..... *Side eye. You didn't really throw the ball did you trump? All that outrage must be exhausting.

Can't have a lame duck president  appointing SCOTUS judges in the last half of his term.

The Republicans already applied the nuclear option to SCOTUS nominees the last time.  The only way this gets significantly delayed is if some Republicans don't like the nominee.

So, Pryor and Haridman were the other two "finalists" from the Gorsuch nomination.  Will Trump go with either of them or go back to the list ??

Although going with the youngest on his list https://en.wikipedia.org/wiki/Patrick_Wyrick (http://Patrick Wyrick) just insure his legacy lasts for a long, long, long time sould also make lefties heads explode.

Forget the Democrats - the only thing that can keep a good Trump nominee from being confirmed are RINOs in the Senate.

And as for RBG - it wouldn't surprise me too much if we've been witnessing a Weekend at Bernie's scenario for the past couple of years already with her.

I thought I remember Justice Gorsuch was approved by the Senate with 54 votes.  So at least two Democrats voted for him (swing state Democrats).  If Mitch can get the up/down vote done before the election, I wonder if those two will do it again or if more of them will feel compelled to vote for the nominee.

Also, we have to remember that McCain is still there. I would expect him to vote with the dem majority, so at least one dem will have to vote with the R's to cancel him out. Also I think there is at least one R in the Northeast who will tend left (Maine?) so that will need to be considered if someone equal to Gorsuch is up for appointment vs a "middle of the road" name.

I recall hearing or reading somewhere, a few years ago, that it's traditional for justices to retire when the party that appointed them is in power. So Kennedy, having been appointed by a Republican, is only following etiquette in retiring during a Republican presidency.

Can anyone confirm?

"Says he's considering 2 women..."

So that shortens the list to:

Joan Larson (https://en.wikipedia.org/wiki/Joan_Larsen) 50yo. Federalist Society Appointed by Trump to 6th Circuit in 2017.

Amy Coney Barrett (https://en.wikipedia.org/wiki/Amy_Coney_Barrett) 46yo.  Per DiFi "The Dogma lives loudly in you."  Referring to her catholic faith during her confirmation hearing when Trump appointed her to the 7th Circuit.  Mother of 8.

Diane Sykes (https://en.wikipedia.org/wiki/Diane_S._Sykes) 61yo. Federalist Society  Wrote opinion in Ezell (https://scholar.google.com/scholar_case?case=17044109654189761463&hl=en&as_sdt=6&as_vis=1&oi=scholarr) where she accused Chicago of being "too cute by half" in zoning out any shooting ranges in the city limits.

Allison Eid (https://en.wikipedia.org/wiki/Allison_H._Eid)  53yo.  Took Gorsuch's spot on the 10th Circuit

Meg Ryan (https://en.wikipedia.org/wiki/Margaret_A._Ryan) 54 yo.  Former Marine.

Odds on Favorites:  Amy Coney Barrett, Meg Ryan.  Long shots: Joan Larson, Allison Eid, then Diane Sykes.

I heard Kennedy mentioned as having largely been in favor of individual rights even when he went against the conservative side.  Does anyone have any thoughts on that?  I have never paid that much attention.

I did hear one speculative thought that perhaps he sees the last few justices appointed by the Democrats and realizes that they are anti-Constitution and anti-Individual Rights.  Maybe he figures someone like Gorsuch is a better choice than someone like Sotamayor even if he doesn't completely agree with Gorsuch.

That's an interesting thesis. I suppose we'll have to wait some years for Kennedy's memoirs to see if that played any part.

From the article:

Senator Amy Klobuchar of Minnesota, a top Democrat on the Judiciary Committee, said that no matter who is chosen, confirmation will rest on the decisions of two GOP senators: Susan Collins of Maine and Lisa Murkowski of Alaska. Both have expressed support in the past for Roe v. Wade, and last year they displayed a willingness to split with their party when both voted to defeat the GOP Obamacare repeal effort.

I still haven't heard anything on what McCain might do. Of late he seems to be going against Trump purely for spite. I read that progressives are gearing up boycotts of LL Bean and I forget what entity in Alaska to try and sway those two senators.

Diane Sykes is very, very 2A.  She treats it and says it should be treated just like the 1A, like it means what it says.  Instrumental in Illinois getting Concealed Carry.  And shes' why the Ezell decision ranks up there with Heller and MacDonald even though it wasn't issued by the USSC.  It set the precedent for Strict Scrutiny in 2A cases.

Unknown about the other three, but I would hope that as a former Marine, Meg Ryan is pro-2A.
