All of the news sources are saying Kennedy will retire. This should make midterms even more interesting.

That will be very interesting. Especially given Ginsburg's age. I'm thinking she's holding off on retirement because, Trump. If he gets a second term though, I don't think she'll last through it even if she wants to.

But his retirement isn't until July. Trump is going to have to move fast to put in a replacement before this congress is done and the next crew takes office in January. This just points up why it's going to be important for us to hold our noses and vote for whoever supports Trump, regardless of other thoughts, views, or feelings.
I only wish Bader-Ginsberg had announced her retirement, but I think she'll stay until she drops dead on the bench rather than allow trump to name her successor.

The bitter 14-month battle over Justice Scalia’s seat, during which Republican senators refused to consider President Barack Obama’s nomination of Judge Merrick B. Garland, will most likely pale in comparison to the coming fight over Justice Kennedy’s seat.
I suspect that's the most truthful statement the NYT has printed in a good long while.

Glorious. First off the BBC calls him a conservative and then goes on to talk about two important LGBT decisions that he led in their favor. So are all conservatives Hitler, or was he not a conservative, or thank you.

The Republicans already applied the nuclear option to SCOTUS nominees the last time. The only way this gets significantly delayed is if some Republicans don't like the nominee.

Well, it is going be really interesting to see if the Supreme Court takes any of the gun cases they have been ignoring when he's gone... concealed carry, AW bans, etc.

Forget the Democrats - the only thing that can keep a good Trump nominee from being confirmed are RINOs in the Senate.

I thought I remember Justice Gorsuch was approved by the Senate with 54 votes. So at least two Democrats voted for him (swing state Democrats). If Mitch can get the up/down vote done before the election, I wonder if those two will do it again or if more of them will feel compelled to vote for the nominee.

Also, we have to remember that McCain is still there. I would expect him to vote with the dem majority, so at least one dem will have to vote with the R's to cancel him out. Also I think there is at least one R in the Northeast who will tend left (Maine?) so that will need to be considered if someone equal to Gorsuch is up for appointment vs a "middle of the road" name.

Three D's voted for him: Manchin (WV), Heidkamp (ND), and Donnelly (IN). All from states that went heavily for Trump.

I recall hearing or reading somewhere, a few years ago, that it's traditional for justices to retire when the party that appointed them is in power. So Kennedy, having been appointed by a Republican, is only following etiquette in retiring during a Republican presidency.
Can anyone confirm?

I heard Kennedy mentioned as having largely been in favor of individual rights even when he went against the conservative side. Does anyone have any thoughts on that? I have never paid that much attention.
I did hear one speculative thought that perhaps he sees the last few justices appointed by the Democrats and realizes that they are anti-Constitution and anti-Individual Rights. Maybe he figures someone like Gorsuch is a better choice than someone like Sotamayor even if he doesn't completely agree with Gorsuch.

That's an interesting thesis. I suppose we'll have to wait some years for Kennedy's memoirs to see if that played any part.

Diane Sykes is very, very 2A. She treats it and says it should be treated just like the 1A, like it means what it says. Instrumental in Illinois getting Concealed Carry. And shes' why the Ezell decision ranks up there with Heller and MacDonald even though it wasn't issued by the USSC. It set the precedent for Strict Scrutiny in 2A cases.
Unknown about the other three, but I would hope that as a former Marine, Meg Ryan is pro-2A.

McCain voted for Gorsuch. He's been voting to confirm judges and the like, it's Trump's legislation his votes against.
