First they uphold the injunction against the hi-cap mag ban, now this:

The ruling by a three-judge panel on the 9th U.S. Circuit Court of Appeals, makes the San Francisco-based court the sixth U.S. circuit court to interpret the Second Amendment this way and could set the issue on a path toward the U.S. Supreme Court, which has not taken up a major gun rights case since 2010.

Interesting.  California is in the 9th Circuit, and currently bans open carry (there are exceptions for hunters and people carrying on their own property).  Crossing my fingers that with Kennedy gone, SCOTUS will grow a pair and take up the case.

My guess is that both rulings will be overturned at the en banc hearing and will have to procede to the SCOTUS.
where upon the SCOTUS will refuse to take either case.

They already did this before a few years ago... which the majority of the judges on the 9th overturned.  It's going to happen again.  We will see if the Supremes continue to crap all over the Second Amendment with Kennedy gone, I guess.

What we need is some more Federal appointments of judges who can read English, especially in the coastal jurisdictions.  I for one am tired of judges who think the Constitution is merely a body of suggestions instead of the highest law of the land.

My guess is that they finally got tired of being turned over more times than a French whore.

Last time I looked (it's been awhile) the 9th Circus Corpse of Judicial Squeals was, by a wide margin, the most overturned of all the appellate divisions.
