I wonder how quickly Feinstein will start screeding about ACB's Catholic faith? After all, we know that religious litmus tests are illegal per the Constitution... but only when applied to liberals.

FEINSTEIN NOT WEARING A MASK! FEINSTEIN NOT WEARING A MASK! FEINSTEIN NOT WEARING A MASK!
ACB IS WEARING A MASK!

Last I heard Schumer was trying to pull a fast one by not letting any D's go to the hearing when a vote to send to the full senate happens. Thus denying a quorum. If it was me, I'd just shut the hearing down tomorrow and tell the Senate leader to have the Senate vote now. There are enough R's for a quorum.
-
Apparently she's not using any reference notes for the hearing. That's some impressive confidence.

Yep. He's screeching about that. And there are ways for the Republicans to maneuver around that. Easiest way, I believe, is for Mitch McConnell to pose a motion on the floor to pull the nomination to the full Senate, which the Dems should not be able to block (thank you, Harry Reid, who gave us the gift that keeps on giving).

Today's looking pretty fun, too. From the quotes in this article she's really doing well holding her own against some of the absolute crap being slung her way...

You know this one made the Dems' heads throb....
Feinstein asks Barrett on Obergefell, which granted same-sex couples the right to marry.
She asks if she agrees with Justice Scalia's view that the U.S. Constitution does not afford a right to marry for same-sex couples.
Barrett says just because Scalia afforded a view, it does not mean if it's hers. She says she isn't going to put forward an opinion.
She cites "The Ginsburg Rule" -- "no hints, no previews, no forecasts."

Huh? yeah, right.
This is your brain on TDS
The thing I find most notable about ACB's answers today is that the GOP traded a hundred thousand American lives for her seat on the court, and there are thousands of Americans walking around healthy right now who will be sick and dead by year's end.

Just one?
That we know of.

It’s funny how the definition of court packing, according to the libs is now filling a vacant seat but then they are literally calling for more justices to be added when they get in power.
-
I guess Conspiracy Bro at work just wants to find some reason to rag on ACB, because anytime she comes up he has to say something about how she's obviously a witch, because she just looks like a witch. Which (har-har) is a full step below the inanity of most of what he says. ;/
Also, how stupid can these people be? This stupid:

ACB needs to use this line at least once during the hearings:
what you’ve just said is one of the most insanely idiotic things I have ever heard.
At no point, in your rambling, incoherent question were you even close to anything that could be considered a rational thought.
Everyone in this room is now dumber for having listened to it.
I award you no points and may god have mercy on your soul.

Interesting tangent: Websters dictionary suddenly changed their definition of "preference" to meet yesterday's liberal outrage. Without stuff like the wayback machine, we would never know this was happening.

And people on Facebook, the TDSers, are going absolutely nuts that she's not using, or taking, notes.
IT JUST SHOWS SHE KNOWS ITS IN THE BAG! SHE'S IN ON THE CONSPIRACY TO PACK THE COURT!
And a lot worse...

That's my assessment as well. I am a very bright person and I watch her knowing that even though I'm pretty sure I could debate the trained monkeys in the questioner roles with ease, I would be very unlikely to be able to draw up every single case/ruling that she's been doing from memory. And she's been doing it with (apparent) ease.
Even the things I know, and know I have read, and can call up, I would still want to have notes so I knew I was quoting it correctly or attributing it correctly. That empty notepad really impressed me.

Quoting a democrat icon at the dems?
The dems probably found that most infuriating. Sort of like the nuns I was stuck with in grammar school when I threw their own words back at them.
-
Oh, the Dems are finding EVERYTHING most infuriating.
It's just a huge ball of fury.
I predict there won't be a single Democrat to vote for her, either in committee (if they stay and actually vote and don't try to derail things by walking out to deny a quorum) or in the Senate.
When a Dem nominates someone for the court, they DEMAND that everyone vote on the individual's qualifications (and that goes for all Dem nominees, not just for the courts).
But when a Republican, especially ORANGEMANBAD!!! nominates someone, the vote suddenly isn't about the nominee's qualifications, is about the person who nominated them.
Yet another reason why I hate the left and all of their flower children.

On the other hand, the Republicans have more seats in the Senate than they did in 2018. Also, the made-up objections to ACB are not nearly as good as the made-up objections to the sinister Brett Kavanaugh.

Dick Blumenthal spent years as the Attorney General of Connecticut, just waiting for a senator to retire so he could run for the senate. He never missed an opportunity to insert himself into a photo op.
Then there was the flap about his military service -- at one time, he claimed he was a "Vietnam veteran." Turns out that was a wee bit shy of being true.

All examples of someone other than an all knowing, all caring, all controlling government saving someone from a life of poverty must be vilified and stamped out particularly if the person(s) doing so are white and the saved person(s) are POC. White people saving POC from a life of poverty is a form of white supremacy don't you know?

Hum... he should have been prosecuted under a stolen honor charge.
Wasn't that law declared to be unconstitutional? I'm pretty sure some court, somewhere (I don't recall whether or not it reached the SCOTUS level) decided that the 1st Amendment guarantees a right to lie about your [lack of] military service.
[Edit}It did make it to the SCOTUS, and it was found to be unconstitutional.
https://en.wikipedia.org/wiki/Stolen_Valor_Act_of_2005
In United States v. Alvarez (2012), the U.S. Supreme Court ruled that the Stolen Valor Act was an unconstitutional abridgment of the freedom of speech under the First Amendment, striking down the law in a 6 to 3 decision.
-
IIRC they filth can't be prosecuted for act of stolen valor but can be if they use the false claim to perpetrate fraud.

Correct. But they won't be prosecuted under the Stolen Valor Act, they would be prosecuted under other laws that apply to obtaining goods under fraudulent conditions.
So I could parade around McDonald's all day long claiming that I won three Medals of Honor in Vietnam and I can't be prosecuted, but if I try to parlay that fraudulent claim into a free hamburger off the Dollar Menu -- ZAP!

It would allow states to ban human abortion, and some would do just that.

Yes, it would rightly return it to the states as the Federal government has no enumerated power to regulate this. Only the fiction created by the courts.
But hey, they just did the same thing with gay marriage so we seem very unlikely to have the courts stop creating powers out of their personal preferences.

I figure some states still have the restriction on their books.
-
Legal abortion and all other legal evils are downstream of culture.
Not that I'm opposed to restrictions or outlawing it, on the contrary.
I just think that it is treating the symptom and not the cause.
Good people do good things and evil people do evil things generally, as a general rule.
When good people do evil or evil people do good it is noteworthy because it is the exception.
-
I sincerely hope so.
Why would you even consider doing that? It's not like you're going to change anyone's opinion.
Well, I consider doing it because lots of people don't really know abortion kills a human being.
Seeing a small human body mutilated may make someone realize what abortion really is.
Remember the Germans who knew "something" was happening to Jews, but it was all out of sight, out of mind?
Seeing films on concentration camp victims open the mind and hearts of some of them, and made them consider what their government had been doing in secret.
I remember reading about german POWs who burned their uniforms after seeing army films of concentration camps.
Abortion involves cutting living human beings into pieces.
If abortion is morally acceptable, people should be willing to see the victims.
If a picture of a tiny dead human with her face cut off is offensive, maybe killing that human being is even more offensive?
Here is an interesting historical photo of German POWs watching concentration camp footage:

Yes.
Germans used the red cross to denote medical personnel during the war, as did most other Western nations. It seems that the Soviets did, as well.

If Lindsey Graham, infamous for his reaching across the aisle betrayals, was able to find his Republican spine under Trump just about any other RINO should too.

Patience young grasshopper. The confirmation vote by the full Senate is supposed to be sometime this evening.

I know, just like the election I just want it over with.

Question: Assuming she is confirmed and sworn in -- or someone else, if something happens to derail ACB's confirmation -- what happens about staff? Did RBG's staff get their walking papers when she died? Supreme Court justices have clerks who do the grunt work of research for them. In fact, ACB clerked for Antonin Scalia, IIRC. So will she get to pick her own clerks, or is she stuck for some period of time with whoever RBG had clerking for her? Could a conservative, originalist justice trust any research done by clerks who were chosen by and who were presumably loyal to a liberal like RBG?
-
Can you imagine a liberal justice tolerating having clerks that previously worked for a conservative justice on their staff? I can't.
Maintaining holdovers from ostensibly "enemy" opposition would be a big mistake.
In my opinion one of the biggest mistakes Trump made when he took office was not immediately replacing every single Obama hold over that he was constitutionally able to replace. I think that would have come close to eliminating much of the early chaos in his administration.

"For much of the history of the judiciary, federal judges carried out their duties with no administrative support staff. The Justices of the Supreme Court were authorized in 1886 to hire clerical assistants known as "stenographers." More than fifty years later, in 1938, Congress appropriated funds for "Miscellaneous salaries" and the hiring of similar staff by judges of the circuit and district courts (52 Stat. 268). Congress replaced the term "stenographer" with "secretary" two years later and in 1947, at the request of the Judicial Conference, authorized all circuit and district judges to appoint a secretary. The following year the authorization was changed to allow federal judges to appoint all "necessary" secretaries and law clerks. In 1959 the total number of these appointees was made subject to "any limitation on the aggregate salaries of such employees which may be imposed by law" (73 Stat. 452). The duties of the secretaries of federal judges, like those of judicial law clerks, have been defined by the individual judges for whom they have worked rather than by statute."

Law clerks generally only serve a single term with a justice. I think there's only a handful who have served a second year.
A clerkship to a Justice is a stepping stone to a career with some of the top firms in the nation, and often brings a substantial signing bonus with it, on top of the salary, from what I'm reading.
-
It is an insult to the American people that the GOP is ramming through a Supreme Court justice with just eight days until the end of an election in which nearly 60 million people have already voted.

Understood.
The SCOTUS is in the middle of a term. Assuming ACB is confirmed and sworn in, she should begin work by the middle or the end of November. Will she be stuck with RGB's staff and clerk(s), or will she be allowed to clean house and choose her own staff?
-
I can't find anything definitive, but I believe that their tenure ends unless the new justice agrees to keep them on.
The law clerks aren't hired by the court, they're hired by the Justice.

Anyone know when they’re supposed to hold the final vote to confirm ACB?

Oh, also, one of the first things Trump should do when he is reelected is to announce (as a troll) that he's going to work to expand the SC to 11 justices, and say he's doing so because it's what the squad wanted. =D

Expected for them to react this way as an adult when as a child a temper tantrum always got them what they wanted. It always worked in the past and now for the first time in their life they're confronted with a solid NO and they have no clue how to deal with it.
