Is being investigated for possessing a 30 round mag on his show Sunday, thus violating DC gun laws.

It's perhaps mean-spirited of me, but part of me does hope that he is convicted, simply because laws should be applied fairly and equally, plus, it may demonstrate some of the absurdity of gun laws to the audience.

D.C. PD and DA's office apparently.
I'd be shocked if anything came of it, but it's nice to at least see them acknowledge it happened.
It's the safe bet it'll be swept under the rug due to a lack of intent, but some legit gun owner ignorant of D.C. law, would likely be in a world of legal hurt.

I actually like Gregory, he's not a too over the top liberal. Maybe he loaned it to some other media folks, and the investigation can be broadened to multiple trafficking and possession violations. :lol

IANAL, but if they don't file charges against him for what's a pretty blatant violation of local law, wouldn't that put future prosecutions in doubt on the basis of "selective enforcement" or something of the sort?

I was thinking that too. OTOH, not everybody who gets pulled over for speeding or a burned-out taillight gets a ticket (or so I've been told. I always get the ticket)

Yrs ago WV Senator Jay "Carpetbagger" Rockafeller was presented w/ a "full-auto" M-16 in DC. SHTF. At first he "didn't know" it was illegal; then, his chief of security had it at Jay's mountain hideout in Pocahontas Co. WV. ;/

Happens all the time in my neck of the woods, though prosecutors here are elected and this would come up in an election. That being said, I think they would look at the circumstances surrounding the whole thing.

If the cops can't tell the difference between a 10 and 30 round magazine by looking at it, they shouldn't be enforcing any laws that require vision to determine infractions.

I hope they prosecute him so that just maybe he might make a comment about the absurdity of this law in DC as well as many other laws. If the DC police informed him it was illegal to poessess the magazine, then his choice was a blantant infraction of the law. He was warned and he had motive. I have heard that people are prosecuted for just a cop finding a loaded round lying inside there car. Stupid stuff.

The articles I have read state the rule is high capacity is forbidden, define high capacity.

It appears to me that the responsibilty weaseling is already at work. Claims they had permission from the ATF (Federal), but not District of Columbia/DC.

ATF permission trumps state or district law? So, if a state bans possession of full-auto's, but the ATF says it's okay, then ATF overrides the state? C',mon, chief. Arrest the guy.
