Man Killed Testing ’21-Foot Rule’

Quote
Spencer Warren told investigators he and Splichal has been debating the “21-foot rule” and were going to see how close Splichal could get to Warren before Warren could fire his gun. Warren says he emptied his .357 revolver but did not fully clear it. When Splichal lunged toward him to test the theory, Warren squeezed the trigger twice, firing 1 round into Splichal’s chest.

This one shocked me a bit when I first heard about it and I had no words.  Later I was wondering how you clear a revolver and forget to make sure all the rounds came out.  And why would anyone do a test where successful completion means someone aimed a real gun at you and pulled the trigger?

The pedant in me would have to point out that if he didn't "fully" clear it (I'm still trying to figure out how you UNfully clear a firearm) and there was a round in the cylinder, then he obviously did not "empty" it. He may have thought he emptied it ... but he didn't empty it.

I was imagining he upended the cylinder and thought all the rounds dropped out and didn't bump the ejector.

Maybe he should have started at 12 feet and worked out from there.  =|
