Sorry, haters, but I agree with what Ben said.

So y'all think a slap on the hand plea deal is in the works?

Sorry to come off as a deplorable, racist, homophobe, but he's an elitist celebrity*, black, and gay. He's got connections and diversity points. It might not be a "get out of jail free" card, but I bet it'll be one of those lame ass probation/community service things where the community service is a catered event. He'll also probably end up making money out of the whole thing.
* Though I never even heard of him before this whole thing started.

What do we think the normal sentence for false reporting of an assault would be?
I can't imagine that's a maximum sentence, jail time kind of thing, especially with no prior record. Does anyone know of a case where someone was prosecuted for false reporting?
Anecdotally I know a couple wives/girlfriends that falsely reported assaults, and when they recanted they just let the guy go and dropped it.

I bet those cases weren't international news stories that embarrassed the city and wasted vast sums of tax-payer funds.
-

While it would never happen in real life, in Ben's World, the false reporter would face the same jail time as the innocent people they set up. In Smollett's case, I'll WAG that the "Trump supporters" would have gotten at least five years for the black/gay hate crime.
Also in Ben's World, there would be no such thing as a hate crime, or if there were, the punishment would be the same as for any other crime.
-
Is he still wearing the noose around, or has he finally taken it off?
Wasn't that one of the rumors, that he alleged wore the noose for several hours after the incident?
-

Got it. This case is kinda different from a nobody filing a false report.
But there were a bunch of agreement's to Ben's post:
I'll believe it when he's convicted and given the same sentence a random schmuck off the street would get.
I don't disagree off hand, but I wonder what we think a random schmuck would get. It's a genuine request for data.
I can google the law and find the max penalties, but I don't think those are likely for anyone, so how are we judging whether Jussie get's more, less, or the same justice a non celeb would get? Does anyone know of a case where someone got jail time for faking an assault? Any of those fake SJ folks from last election go to jail? What is the norm? While I understand that the City of Chicago spent some money and manpower investigating, it's not like it is known for great fiscal management. His crime's "victim" is pretty nebulous.
-

I thought there was video to that effect.
I recall having seen at least a picture of the "noose" made with cotton clothesline rope around the French actor's neck.
-

I'd be curious as well. I would say there is a difference between the people who smash their cars with a baseball bat and cry "X" diversity hate crime, and the Smollett types, where he both hired people to smack him around, and then we initially "had video of the attackers", and I'm not giving high odds that Smollett would have come clean if some innocent randos were picked up and prosecuted. I think he would have let them go to jail, no problem.
Just like some of the stuff we've talked about in the past, where someone was accused and identified, but it was a case of spite and they were innocent. Their lives were still ruined, even after they were cleared of a crime. I can see letting the "car beater" go with probation or whatever, but when you plan something that would get innocent people locked up, you need to be locked up.
Not really the same thing, but it seems these celebrities involved in the college admissions scandal are getting off easy, and easier than someone without fame or money.
Then I guess we have the other side of it, where, for example, Roger Stone was up for 9 years in prison for something that would get someone else a slap, or wouldn't even be considered a crime. All because he's famous in the wrong way by being aligned with Trump.
-
I thought that it was a horrible precedent to not prosecute someone trying to cause social upheaval by committing fake hate crimes, I also think its probably worse, if there is no meaningful punishment handed down if he is prosecuted.
-

How can you prosecute someone when they self-identify as an honest person?
That would be hurty and wrong.
-

Not a rumor -- documented. He was still wearing it when the police showed up at his apartment in response to his call.

That's residue of the vision Obama had for America.

Interesting.
I'd not followed the case closely at all, but I remember when it originally happened I just had this nagging feeling that there was something off about the allegations.
-

I would like Smollett to receive the same sentence as any nobody who reported a fake crime, which was international news, and embarrassed the city, and wasted vast sums of taxpayer funds.
Or think of it this way. Some of us would prefer heavier penalties for crying wolf, and we'd like for it to start with that inarticulate America-hating homosexual with the silly name.
-
I agree. He should be prosecuted. If found guilty, he should get a consistent sentence and forced to serve it out 100%. No good behavior or early release.
-
I would like Smollett to receive the same sentence as any nobody who reported a fake crime
Some have suggested that Smollett should receive the same punishment as the perpetrator of the "hate crime", had it actually occurred.
-

-

That is fine and all, but it sure seems like such a law would just be another in a long list of laws that don't really accomplish much. Lying to police and/or perjury should offer plenty of punishment. We need to simplify our criminal punishment laws and use them, not add on more. If they actually prosecute him instead of doing the sweetheart plea deal, it should be enough.

They might as well have done six counts of jaywalking.
-

What is a sentance?
-
Yes. That's the take away. I misspelled a word.
You've cried for several posts now that Smollett's going to get off "light", despite the fact that no one here seems to have any idea what the baseline is, you're just sure that he's getting preferential treatment because of money and/or SJW politics.
But by all means continue to bloviate uselessly because I misspelled "sentence", in a context to in which my meaning was pretty dang clear.
-
Smollett's going to get off "light", despite the fact that no one here seems to have any idea what the baseline is, you're just sure that he's getting preferential treatment because of money and/or SJW politics.
While I'm still interested in as you said, "baseline data", rereading the thread, something Brimic said stood out:
I thought that it was a horrible precedent to not prosecute someone trying to cause social upheaval by committing fake hate crimes,
That is something it will be hard to "baseline", because it's where his "fame" comes in. His celebrity and political and other connections created a situation where there could have been actual riots leading to property destruction, injuries, or even death. There is no doubt that his celebrity and diversity got this 100x the exposure it would have gotten were he some black, gay guy living in suburbia and working at an IT firm or similar.
I guess a sorta analogy might be the Zimmerman/Martin thing: Had Al Sharpton etc. not gotten involved, or had it been white on white or black on black thing, we wouldn't have had BLM, violent protests, and everyone's routes to work being blocked, causing all kinds of expensive upheaval.
Maybe it's the 24/7 news to blame for "celebrity escalation", and it's unfair to hand a harsher sentence to the famous person, but I think there is little doubt that the damaging fallout to innocent society is greater than if some unknown does the same thing.
-
it's the 24/7 news to blame for "celebrity escalation", and it's unfair to hand a harsher sentence to the famous person
This is the unfortunate reality.
I don't think it's wise to try for some kind of famous person modifier assuming you're also opposed to a hate crime modifier.
But by all means continue to bloviate uselessly
[popcorn]
I honestly don't know why you'd expect anything else.

dogmush,
Before you got into baseless personal attacks, you were making a good point. It seems like this is an emotional issue for you, but the fact that I countered your argument and mocked your spelling doesn’t make my 4 short replies into several posts of crying or bloviating, as you claim.
I think you’re probably right that people reporting fake crimes don’t usually get the book thrown at them. Still, if one of those cases became as high-profile and expensive as this one, I think it’s not unreasonable to expect that the city would throw several books at them. I suspect, if I staged a hate crime in Chicago, and it somehow became as big a story as the Smollett case, I would be in far more trouble than Smollett is now. That's because I'm not wealthy, famous, black, or a pervert.

Sophisticated criminals or not, they are black. And Smollett reported that he was assaulted by two white men.
-
it seems that the lefties did thousands of fake hate crimes iirc
its about time some one got prosecuted for it
-
"While I understand that the City of Chicago spent some money and manpower investigating, it's not like it is known for great fiscal management. His crime's 'victim' is pretty nebulous."
While that may be nebulous, laws against false reporting (whatever the punishment) discourage others from pulling stuff where false reporting actually causes problems for the victim. :"For the discouragement of others" is a valid reason for some laws, with appropriate punishment.
The punishment for perjury comes to mind for this one, and I believe some law or whatever somewhere said, "Thou shalt not bear false witness" or some such archaic principle. Wish I could remember where I saw that. I guess the punishment for that one was you got somebody in high authority pretty mad at you.
By the way, is he the guy doing commercials for hair loss treatments? Commercials can bring in a pretty penny for the actors, you know.

Anyone know his motive? Was it for publicity, or to make a political point, or equally both?
Smollett?
Allegedly it was to get more publicity so the studio would pay him more for his role in Empire.
There is also a take that he had received a threatening letter and the studio didn't take it as seriously as he thought they should, so the attack was to "prove" that he was in peril. There was suspicion that he actually sent the threatening letter to himself.
-
It seems like most of the "hate crimes" have been staged...
It is getting old.
-
For staging a hate crime.
I hate the term "hate crime" to begin with, but would argue that staging one should get the same punishment as the real thing. If you're into considering "hate crimes" valid.
-
This aged well
A still-disputed aspect of the attack on Smollett is a line shouted after his attackers fled the scene: "This is MAGA country." While its veracity isn't confirmed, its sentiment needs no fact-check. America's choice to embrace the blind rage of late-stage whiteness in decline is an explicit longing for this kind of crime, a version of America in which those who do not assimilate to the satisfaction of their white, straight, and Christian betters are subject to the impunity of law enforcement, the scorn of the media and the fury of racist homophobes stalking the streets of your city, who want you to know that they could lynch you if they really wanted to, and maybe get away with it too.

In a statement issued Monday, the Cook County Sheriff’s Office said Linn ordered that Smollett be held in protective custody and the actor being housed in a part of the jail with “enhanced monitoring,” which is used for both individuals with mental health issues and those who require extra security. Smollett is not on suicide watch, and “it would be inaccurate and irresponsible to make any assumption about his mental or medical condition based on where he is currently housed.”
In a statement issued Friday, the sheriff’s office said while in protective custody, Smollett is alone in a cell monitored by security cameras and with a guard stationed at the cell door.

Smollett defense attorney Nenye Uche, ... also called Judge James Linn's sentence excessive for a low-level felony, adding that the appellate court doesn't “play politics.” “The real question is: Should Black men be walked into jail for a class 4 felony? Shame on you if you think they should,” Uche said.
Question, Mr. Uche: is the sentence excessive for everyone, or is it only excessive for a black man? Would you have proclaimed the sentence (which could have run into multiple years) excessive if the defendant was a white man?

We know that none of the 06JAN protestors have, or will, get this kind of deal.
Their mistake was not chanting "Black lives Matter" while milling around the capitol and not looting and setting fire to it.

And he's out (for now).

Does anyone know how common it is for rich folks to be on bond pending the outcome of an appeal? Race aside, he is rich(ish). And it's not like he was pardoned or anything, he was granted a bond until his appeal is decided.

For appealing a conviction getting bond is not unheard of. Simply appealing a sentence, particularly one so short already, I’ve never heard of anyone getting out on bond. Unless the judge really thinks a shorter sentence is highly likely getting released on sentencing appeals has to be almost unheard of.

Jussie filed an appeal of his conviction on March 1, but entertainment industry insiders are saying that he's dead meat for future acting jobs.
My guess is that will last about 2 years until someone wakes up and realizes what a poor, beset upon individual he was and that he acted out of desperation to protest the endemic racism in society... And like Michael Vick, he's now completely rehabilitated.

Agreed. His blacklisting (wait, did I just use that raysis word?) in Hollywood won't last long. He'll be busy working again in a couple of years. Word is he already has a gig on BET.

Never use "Stacy Abrams" and "mate" in the same sentence.
