Judge finds FOID card law unconstitutional as applied to one Illinois woman

This case out of the Second Judicial Circuit in White County, People v. Vivian Brown, involves a challenge to the constitutionality of the FOID law that arose after Brown was charged with possessing a rifle in her home without a FOID card in 2017.

At the time, Brown was eligible to obtain a FOID card but did not have one.

Brown argued the law violated the Second Amendment because it prohibited a person who could legally possess a weapon from keeping one in his or her home.

Don't count on it.  From what has been posted over at Illinois Carry (http://illinoiscarry.com/forum/), they think that the court has narrowed the focus so that only the defendant will actually get the benefit.

Well ... the defendant, and anyone else in a similar situation.

But if you read the decision, I think it may lay the groundwork for future chipping away at the FOID. But we need to remember that all transpired in Illinois state courts, so whatever effect it has will apply only to Illinois.

The Chicago metropolitan area has grown dramatically over the years. Formally Republican (mostly RINOS) areas have drifted even further to the left.

Many suburbs have been inundated with immigrants from all over the world. Not the poor teeming masses either. They've got money, attitude and they vote Democrat. Blacks and Mexicans who can afford it, escape the Cook County insanity and move to the suburbs bringing their voting habits along also.

I just don't see how the rest of the state can hold off the flood of leftist skullduggery. If you think putting your faith in Federal Courts to protect your rights is silly, then depending on Illinois courts is a real laugher.

My FOID card literally broke in half the week before I moved out of the state. It felt sooo good to just toss it in the trash.

I, too, don't have much expectation that this will come to anything.
