So, the guy is being mugged.
The mugger, somehow believes he can move faster than bullets tries to dodge them.
Mugger fails but being NYC where reality is right wing propaganda, self defender to be charged.

I've thought for a long time that NYC and similar type places ought to have a reputation as a place good people don't want to go to. You know, "bad stuff happens to people there."

Internet folks love to say "I'd rather be judged by 12 than carried by 6.", but it still sucks to see. The article says he was interviewed a couple years ago about the increase in crime in his neighborhood, and was lamenting the lack of safety. Not being rich or connected he had no way to legally defend himself, and now we're here.
The DA and rich liberals would happily have fed the old guy to the grinder of street crime rather than examine their own assumptions, and will happily jail him, and destroy the rest of his life rather than admit they may be on the wrong track.

Decades ago in NYC, Bernie Goetz went to jail on gun possession charges even though a jury refused to convict him for shooting his assailants.
The powers-that-be wanted to get him SO badly they gave immunity from prosecution to the perps who tried to rob him in order to get them to testify against their victim.
I don't remember all the details, but Bernie didn't do himself any favors by opening his mouth afterwards. In the OP, maybe the guy being charged SHOULDN'T have called 911 and just walked away.
