RANCHO CUCAMONGA - A 44-year-old man was sentenced to 180 days in jail this week for getting down and dirty in the parking lot of a busy shopping center.

Kip Pennington of Yucaipa stripped completely naked, covered himself with lotion and then gyrated in a dirt planter near the Trader Joe's market at Haven and Lemon avenues in Rancho Cucamonga, authorities said.

"The witnesses described him as `making love' to the ground," Deputy District Attorney Henry Rosas said.

Pennington got caught after an employee of a nearby business saw his feet sticking out of some bushes, toes down, on Dec. 21, 2005.

The worker got his boss, who peered into the bushes and saw Pennington in the dirt.

"He described it as if there should have been a woman underneath him, but there was no woman," Rosas said.

Sheriff's deputies arrived and arrested Pennington.

Pennington represented himself in a trial that ended last week in West Valley Superior Court.

Jurors deliberated only 13 minutes before convicting him of indecent exposure and committing a lewd act in public.

Rosas said Pennington was sent for psychological evaluation before the trial and was found to be mentally fit for court.

The prosecutor said the act occurred in a high-traffic corner of the shopping center, not far from homes, in an area frequented by families and children.

Pennington is due back in court May 15, at which time Judge Michael Libutti

i can't decide who is the worst. these fellers or that guy in wva who got caught in the living nativity scene with the sheep. they put his picture in the paper then released him on bail  i figure he hada either leave town or kill himself
It is much more powerful to seek Truth for one's self.  Seeing and hearing that others seem to have found it can be a motivation.  With me, I was drawn because of much error and bad judgment on my part. Confronting one's own errors and bad judgment is a very life altering situation.  Confronting the errors and bad judgment of others is usually hypocrisy.
