Guy goes outside for a smoke, sees two teenagers actively robbing his car. Goes to confront them, one of them runs off and the other hides. Man confronts the one who hid, the teenager stabs the guy in the stomach, man does not realize he was stabbed. Kid gives back the stuff he stole and man allows him to run off, then realizes he was stabbed and calls 911. Cops find both kids and charges are pending. The teen who stabbed the guy tried to claim self defense which is not going to hold water.
My questions and comments:
1. Guy should not have confronted somebody committing a crime unarmed. The teen who stabbed him IMHO forfeited his life as soon as he introduced a weapon into the equation. That said, some items in a car are probably not worth the aftereffects of a shooting. I'm not sure what the right answer is, yell from the porch and call 911?
2. There are comparisons between this and an incident in town several years ago where a teenager was robbing a car, the owner saw him and open fire killing the teen while he was running away. He was convicted of either murder or manslaughter, I forget which. I have a problem with the comparison, in this incident there was a threat to the car owners life, in the previous incident the guy opened fire on the robber from a distance hitting him in the back of the head while running away. It was definitely not a good shoot, plus he was drunk which did not help his case any.
3. Guy gets a 3" stab wound in the stomach, that sounds pretty serious and potentially life threatening to me. Where is the line between assault with a deadly weapon and attempted murder?
