I like to point out that public health laws still allow for the arrest and detention of persons carrying conditions dangerous to the public health.  Those laws did not go away after Typhoid Mary died.

Hereabouts, back in the mid-90s, there was a case of an AIDS infected prostitute.  Details are fuzzy in my memory, but she was in and out of this and that with a lot of publicity.  All sorry, and said she found Jesus, but could not keep away from that life.  They eventually stuck her in jail, which is where she ended her days.

I slightly misrecollect.   Gov. Jim Edgar commuted her sentence when she was at death's door.  " attempted criminal transmission of the AIDS virus "

I'd say that's a little fuzzy in terms of right and wrong. Buyer beware and all that.

However, I've got no issue with people who have highly infectious diseases to be detained and quarantined. The fact that TB is still a major issue boggles my mind. The drugs are available and should have been just thrown out for free to the poor who couldn't/can't afford them. Not as a feelz good thing, just as a public health issue.
Instead, we now have drug resistant TB. =|
