They'll rule narrowly that its illegal for NSA to do it, but then we still have to play legal whack a mole with every other agency in the country that collects phone data, going alk the way down to the local level.

Doesn't much matter if they don't care...

Should I be comforted that the Executive ignoring the Judicial is a long storied tradition within the U.S.? Going back all the way to Andrew Jackson at least, if not Washington himself.

I can't decide if the Framers leaving the Judiciary (and the Congress, outside of refusal to fund things) somewhat toothless in the face of the Executive was a mistake, or if they had some kind of police or troops that could at least try and enforce things on the other branches ignoring their Constitutional powers would make things fall apart even faster.  ???
I promise not to duck.

Well unfortunately the Supreme Court has been *expletive deleted*ing up by the numbers lately, so no I don't see a SC case really going the right way.

Only thing that might stop NSA is dismantling their infrastructure brick by brick and blackballing the employees form federal employment in the future.

It's not just the NSA that's lawless, the Obama administration just admitted they ignored a Federal judge's order on immigration.

Why do they do it? Because they can get away with it. Nobody will be prosecuted, nobody will be fined, nobody will go to jail.

So . . . why comply?

Yup. Pretty much the only people who obey the laws any more are the suckers in the middle class. Everyone from government, corporatists and banksters, illegals, and the urban underclass know that the laws only have teeth if you either have something to lose or don't have enough power or money to make the legal problem go away.

My money says the NSA will give the finger to the Court, and continue to do what they are told to do by the current administration.  Obama and company have already proven that Congress is irrelevant,  I am sure that to them, the Court is also.

for those that have been sleeping, the coup d'etat has already taken place.  We lost.

That would be a great campaign stance for the next President- Prosecute every federal employee who violated the law during obama's terms.

You think such a candidate, if even remotely viable, would live to see the election?
