People are going to freak about this...

I'm sure that this is a lawyer inspired move to prevent his being sued by the estate, but wow. This is just going to fan the flames in Chicago.

If there's any justice in Chicago, the executor of the kid's estate will put a contract out on the cop.

Maybe I misread the article, but it sounds like the cop is suing the estate of the "kid" (a 19-year old is a man) with the baseball bat, not the innocent neighbor that was killed.

Don't know how I feel about the lawsuit, but is there anyone here who wouldn't shoot someone who was about to open their head like a ripe melon?

I kind of like this turning the tactics of the DinduNuffins against them. Innovative.

Now they need the police officer's mother to be on TV saying "He wuz a good boy, he dindu nuffin!"

So the cop is suing the "estate" of the teenager he shot and killed.

OK.

Does the "estate" of the dead teen actually have anything of documented value in it? Stocks in his name? Bonds? Bank account? Cars, boats, airplanes titled to him?

And . . . exactly who will have to deal with this? Does the "estate" have a named executor? Or are the next of kin (parents?) getting sucked into this bovine excrement?

Well since the Father of the deceased 19 year old filed a wrongful death suit "just days" after the shooting on Dec 26.  So it's very likely that a nice insurance payout from the city will be available for judgement soon.

I dunno, Dad says the guy was like 20 feet away, was the one that called the cops, and unarmed.  Cop says that the guy was 3-4 ft away from him swinging a bat.  No actual evidence or investigation has been released yet.  Seems like with that kind of disparity of stories the physical evidence will clearly favor one or the other.  So I'll  [popcorn] and see what happens.

And through it all, no one mentions the elderly landlady who got capped by a through and through from one of the 6 (!?!) rounds fired into the dead 19 year old.  She was having a bad day.

I did not know that. I need to grab a bag of popcorn as well then.  I assumed it was either close up or running towards the cop.

Regardless of the cop's lawsuit. It seems like the landlady's surviving relatives should have a lawsuit option against the cop, city, and/or the 19-year old's estate, depending on what the evidence lays out.

Yeah "accounts differ".

Quote from: Cops Lawsuit
After Rialmo stepped into the front door of the building, LeGrier came "barging" out the front door of the second-floor apartment, holding a baseball bat in his right hand, according to the lawsuit. Rialmo had been standing in the front doorway, and when LeGrier got downstairs, he "took a full swing" at the officer, "missing (his head) by inches, but getting close enough for Officer Rialmo to feel the movement of air as the bat passed in front of his face."

Rialmo backed onto the front porch near the top of the front stairs, and "repeatedly shouted orders for LeGrier to drop the bat," but the teenager instead followed him onto the porch and took another swing at Rialmo, the lawsuit states. Rialmo, who was still shouting for LeGrier to drop the bat and had his gun in his holster, then backed down to the bottom of the steps.

LeGrier stood "with the baseball bat cocked back over his right shoulder with a two-handed grip, approximately 3 feet above Officer Rialmo and approximately 3 to 4 feet from where Officer Rialmo was standing on the bottom step of the front porch to the building. Officer Rialmo feared that LeGrier would strike him in the head with the baseball bat so hard that it would kill him," the lawsuit states.

"Rialmo reasonably believed that if he did not use deadly force against LeGrier, that LeGrier would kill him. Officer Rialmo drew his handgun from its holster, and starting to fire from holster level, fired eight rounds at LeGrier from his 9 mm Smith & Wesson handgun, which holds 18 rounds, in approximately two and a half seconds," the lawsuit states.

Quote from: Dead folk's Lawsuit
According to the lawsuit filed by Antonio LeGrier, his son was inside the building when he was shot and Rialmo was outside. The suit also alleges the younger LeGrier did not present an immediate threat to anyone before the shooting, including any police officers.

Quintonio LeGrier also wasn't doing anything illegal immediately before or after he was shot, according to that suit.

In the lawsuit filed by the Joneses, "Bettie Ruth Jones faced a hail of bullets being fired by an on-duty Chicago Police Department officer at and in the direction of her home ... with bullets going through the doorway, and through the walls of the home..."

One of the lawyers for Jones' family has said Rialmo was about 20 feet away when he opened fire.

No, he is suing the teen who he shot and wounded because he was holding a baseball bat, not the person who was killed by the bullet that passed though the bat wielding man who he intended to shoot.

No.  They are both dead.

The cop Shot and killed a 19 year old man that the cop says was holding a baseball bat.

One of his rounds went through the 19YO and struck and killed a 55 year old woman (the 19YO's downstairs neighbor) by accident.

Two dead people.  The Cop is suing the estate of the 19YO that he meant to shoot, not the 55YO he killed by accident.

Not necessarily premeditated but certainly intentional.

Really? You think the cop intended to kill the 55-year-old woman?

Not at all, nor do I consider the collateral killing murder. Manslaughter of some degree maybe. Homicide and murder are not synonymous.

Maybe the 55yo victim can sue the perp's estate too.....especially if the city pays off the perp's estate.
