Judge to Electors -- You gotta vote for the state-wide winner
« on: December 13, 2016, 09:22:04 AM »
Specifically addresses a Colorado law, but it's a ruling from a Federal judge, so it should have legs.

Question is, what happens if electors ignore him?

Essentially it's the electoral version of jury nullification. Except untested. I wouldn't expect the legal system to like it even if that aspect was originally considered a feature and not a bug.

With all this horsecrap going on I won't be completely comfortable with this election till January 6th and maybe not till after Noon on the 20th.
I have no doubt that the left is ethically capable of mucking this thing up, I'm just not sure if they are stupid enough to try it.
If ye love wealth better than liberty, the tranquility of servitude better than the animating contest of freedom, go home from us in peace. We ask not your counsels or your arms. Crouch down and lick the hands which feed you. May your chains set lightly upon you, and may posterity forget that you were our countrymen.

Untested? I've read that there were 137 total faithless electors since the founding. It's happened before, just never enough to swing an election.
I wish the Ring had never come to me. I wish none of this had happened.

So do all who live to see such times. But that is not for them to decide. All we have to decide is what to do with the time that is given to us. There are other forces at work in this world, Frodo, besides the will of evil. Bilbo was meant to find the Ring. In which case, you also were meant to have it. And that is an encouraging thought

But were they really faithless electors? Not all states are winner-take-all.

They were. However, about half of them were "faithless" because their pledged candidate died before they could vote.

Untested in court, specifically regarding laws against being faithless electors. But untested in general.

23 of them refused to vote for Van Buren's VP because he was sleeping with a black woman and admitted it. Another 32 were also related to Van Buren, don't recall the why specifically. 63 were because Horace Greeley died before taking office. That's the virtual majority. The rest were ones or twos.

How do people get to be electors when they don't even understand how the electoral college works or why it exists?

In Iowa they get voted in a party's state convention. If you can convince enough people to vote for you, you can get picked.
