The State points to preliminary data from the Hawaii Tourism Authority, which suggests that during the interval of time that the first Executive Order was in place, the number of visitors to Hawai‘i from the Middle East dropped (data including visitors from Iran, Iraq, Syria and Yemen) … Because there is preliminary evidence that losses of current and future revenue are traceable to the Executive Order, this injury to the State’s proprietary interest also appears sufficient to confer standing.

There is a headline out that a Hawaii federal judge blocked Trump's second executive order on immigration.  Looking at the Breitbart articles, it just makes me wonder what he is smoking.

I am not sure if this link explains it better.  I think the judge is inventing reasons to pass an injunction and pretty much trying to usurp executive authority.

He's the anti-Roberts. Roberts bent over backwards to ignore the intention of the authors to claim that because it could be considered a tax, it's a tax.

This judge is bending over backwards to ignore the plain language of the order to claim that intention makes it illegal, even though the wording is clearly legal.

And it sounds like he is claiming a bogus constitutional right rather to avoid making a ruling on the language of the law.

I recall people pointing out how someone like Hilary Clinton would start banning guns if she couldn't pass new laws.  It was pointed out that all she needed was some key judicial decisions.  See the rulings by some of these crazy judges making up rights and such to achieve their ends it really seems it would be very easy to do and would have happened sooner than most figured.

True. Just read an op-ed article a few days ago in which the author alleged that the imaginary "right" of people to not be scared by the sight of a firearm overrides the Second Amendment right to bear arms. The article was in support of a new anti-gun law being discussed in my state's legislature.

One of the plaintiffs in this blockage of Trumps executive order was a naturalized US citizen whose mother-in-law lives in one of the six countries affected by the order. His "standing" is that with the order in place, his mother-in-law wouldn't be able to come to visit her daughter, and that he would be "hurt".

Now "hurt" is standing to block the president from exercising his constitutional authority.

If I'm understanding this correctly ...

Current 9th circuit covers Alaska, Arizona, California, Hawaii, Idaho, Montana, Nevada, Oregon, and Washington plus Guam and the Northern Mariana Islands.

Proposed 12th circuit would cover Alaska, Arizona, Idaho, Montana, Nevada, and Washington

Proposed 9th circuit would cover California, Hawaii, Oregon, Guam, Northern Marianas.

This ruling just follows the precedent set by the investigation of Hillary. The wording of the law didn't matter,  it was the fact that she didn't "intend" to break the law.

Now we have Trump and while the wording may be legal, the judge says he "intends" to break the law.

Whats good for the gander is good for the ganders followers.
