Death Race 2000 in North Carolina?

Quote
A new bill has passed the NC House that would allow North Carolina drivers to drive through protesters who are blocking the road without being sued, as long as they “exercise due care.”

Future court cases will, of course, revolve around the definition of "due care."

Intentional targeting of protestors would still be illegal.  Pity.

It shouldn’t have required a special law. I’ve always though that when protesters or anyone else block someone from driving through a public road or right or way that they were effectively holding the driver hostage. Especially if they are pounding on the car or throwing things at it. It always seemed self defense to me to drive through them. Unfortunately I’m sure a lot of Judges and Juries would disagree.

I never understood though how so called civil disobedience allowed people to block others from proceeding through any public doorway, sidewalk, road what have you driving or walking. Anyone doing such should immediately be arrested and if they touch someone or trap them in a location to me it would always be self defense to do whatever is necessary to proceed.

Legality aside, I think I would pretty much always consider my life/well-being in danger at the point that people start pounding on or shaking my vehicle. Possibly, depending on circumstances, much sooner and before they laid hands on the vehicle.

At the point of physical contact though, for sure. At that point my safety becomes too unpredictable. Otherwise, I agree that it pretty much always falls into "kidnapping" if they block my vehicle and won't let me through. In a fair world, you should always be able to proceed through such barricades before the cops arrive, and if the cops arrive and don't clear things out, you should still be able to proceed. I don't care what your cause is, even if I'm sympathetic to it. You have no right to stop my free movement on a public roadway whether you're BLM or the NRA.

I agree with the last two posts, and I'm thankful I've never been so blocked. Concerns that BLM "protesters" may intend harm to their hostages is especially poignant, given the history surrounding that movement, and the toxic racial politics they stir up.

IIRC there were several incidents of motorists blowing through BLM roadblock protests and several people were injured. Any news on the outcomes of those?

I like that there is some protection for the driver if protesters are actively trying to block them on a public roadway.  Most of the videos I saw of people pushing through the protest didn't hit anyone, but one or two got going a bit fast.  I am a small bit afraid someone is going to interpret this as they don't even have to slow down.

I am also hopeful that just having this law will mean protesters look for other ways to get attention rather than blocking the roads.  I imagine that is the primary purpose/result of this law.
