Remember the NY motorcycle road rage attack?

The cop and one of his cohorts were convicted today
http://news.yahoo.com/judge-convicts-ny-detective-bloody-road-rage-chase-173013752.html
Pretty much caused the accident (motorcyclist brakechecked the SUV after cutting them off and got run over) and then they turn into an angry mob.  Remember that?

"Within a matter of minutes this group of bikers began a ferocious and unrelenting assault on the victim, alarmingly close to his wife and young daughter," said Manhattan district attorney Cyrus Vance.

Ok. Is it just me? When I see statements like that, it makes me think are they saying it would have been no big deal if the wife and young daughter weren't there. I mean I get it, the DA is trying to score points. However sometimes statements like this make it sound like the punishment should be more because of the presence or the wife and daughter when to me a brutal assault should be punished the same no matter what.

Apparently some people still think that women and children get to board the lifeboats first.

The prosecutor probably wanted folks to realize that besides the guy getting pummeled physically,  his wife and daughter were being emotionally/psychologically assaulted.  A threefer, if you will.

Instead of charging a crime for each victim involved they are trying to create an enhanced punishment mentality.  Sadly, the judge has the option of running sentences consecutively limited when there are not multiple victims involved.

stay safe.
If cowardly and dishonorable men sometimes shoot unarmed men with army pistols or guns, the evil must be prevented by the penitentiary and gallows, and not by a general deprivation of a constitutional privilege.

Sounds like an adequate outcome.  I wonder about the outcome had that happened in a free state.  Either action by the driver or bystanders.

Yeah. I get that. Standard practice and the add on crimes idea. What I have the issue with is if someone commits a violent crime they should be prosecuted the same no matter the family being there. I thought I said it in the earlier post, but why should the punishment be less if the wife and daughter weren't there? The same crime occurred, right? These bikers were obviously violent and out of control - throw the book at them regardless of the family being involved. Would they have gotten a lesser sentence if the family wasn't there, I would hope not.

I remember seeing this one and thinking "The banker forgot he was driving a battering ram" when the bikers became pedestrians and assaulted his vehicle.

I thought I recall he got stuck in traffic, but it has been a while.

I remember ... and I am pleased that the cop will be doing hard time, and can no longer [pretend to] be a cop.
