If this guy goes to trial on the felony charge of "assaulting a public official"  were I to be on the jury my question would be "Would he be facing felony charges if he'd hit ME in the face with a pie?"

An answer of "No" would mean an automatic "Not Guilty" vote.

Disagree. Public officials, even if the bestest least corrupt and most fair theoretically possible, will still piss people off. Think judges. Statistically at least 50% of people will be unhappy of any verdict. They have a heightened threat because of their job and there should be incentive not to take out your frustration.

That said, I'd be fine if it was generally a felony to commit assault while being a hippy.

We don't see eye to eye on this, as I do not and will not agree that I or members of my family are deserving of less legal protection than any government employee.

I will go with Rev's take on this -- but with a caveat-

What is good for the goose.......

If the public official is the one breaking the law, the penalty imposed should be double what an ordinary joe gets-

And for exactly the same reason.  They have placed themselves in a position of trust. Thus the offense in not merely against the individual, but the office.

Concur. Public officials are sometimes placed in positions that ordinary folks are not. However, with privilege should come equal obligation. Doesn't work that way in reality. They get the perks and usually a lot less responsibility than the average tax payer. So, this is more my theoretical position and Hank's position is moreso my real world thoughts. Kinda like the death penalty. I'm fine with it in theory. Reality is government is too corrupt and incompetent to be trusted with it.

In case I didn't sound contrary enough to begin with.   =D

I'd take it another step: if a public official fabricates/illegally suppresses evidence or in any other way attempts to frame someone for a crime, the penalty for doing so will be the same as the maximum for the crime in question.  Try to frame someone for capital murder, you get the death penalty.

He may not have any regrets now, but he will once he's in prison. Talk about stupid -- the mayor will be out of office in two months, so what's the point of pie-ing him now?

Were I grabbed from behind and had something slammed into my face, I most certainly would come around swinging with the intent to put down whoever was trying to hurt me.
*shrug* I'm not sure how fast I would register that the "attack" was just a pie in the face, especially if there was a lot of yelling. Admittedly, I can be kind of slow on the uptake in those sort of situations.

I'll admit, seeing those pictures of stinky hippy SJW with a black eye and cut did make me happy.  =D

What exactly do you mean by legal protection?  That can take us along a lot of roads.

The biggest difference to me is the local prosecutors are likely to actually prosecute this case even though he will still plea it down.  If it was just a guy walking down the street that was hit with a pie, it is unlikely charges would even be filed.  But that is a symptom of poorly run city govt as much as unequal protection.

Still a felony charge for a pie in the face is a bit much which is why I bet they plea it down and it never gets to trial.

Any bets on how long it will take for some tile crawler to come out representing smelly, pie slinging hippie in the civil suit against the mayor for the beat down?

Remember, this is the city where Harvey Milk was shot and killed.  I wouldn't be surprised if the TPTB go to the mat with this one...

Insufficient sample size.  Need at least 99 more hippie SJWs to do this so we can reach a proper conclusion.

For the sake of comparable data,  they all need to do it to this same mayor.  Let him perfect his ground and pound  >:D

Makes me imagine one of those over the top action films or something where someone hits a big dude with something hard and he just turns his head and glares at them and he realizes his mistake.

"hey managed to escape but left behind the Tahoe, which was registered to Lester Jones, a man who was later found dead in Georgia."
