WAYNE, W.Va. (AP) - Authorities are investigating the death of a former Ohio minister whose body was found at a shooting range in the Beech Fork area.

The Rev. Mark McCalla's body was found Thursday morning. Wayne County Sheriff David Pennington says McCalla suffered a single shot to the head. Police say it's a homicide.

Before serving at Highlawn Presbyterian Church in Huntington, McCalla worked at churches in Columbus, Ohio, and Corry and Franklin, Pa.

McCalla's body was found about an hour after he served breakfast to a group of volunteers working to improve area housing for low-income residents.

Pennington says authorities are not sure if the 45-year-old went to the state park by himself.
One day at a time.

First-degree murder warrants were filed in Huntington, West Virginia against 22-year old Daniel Smith of Cincinnati, and 19-year old Stephen Wilson of Virginia in the shooting death of 48-year old Reverend Mark McCalla. Smith and Wilson are U.S. Army deserters, and had been stationed at Ft. Drum in New York, but the Army says they have been gone since May.

Do they have the death penalty there?

Son of a bitch.

At least they got the bastards.  Now for the trial, may it be flawless, and hopefully, the death penalty.

I think Ohio has the death penalty.  But does Ohio have the final say?  As they are Army deserters, couldn't they face courts martial and a death sentence from Uncle Sam?

They'd be subject to the UCMJ unless the Army decides to let them be tried under civil court.  Or hit them with both civil and military courts.

I don't think that they will be subject to UCMJ for the murder.  I maybe wrong but since it didn't happen on a military installation or to another member of the military the civil courts will handle that.

Umm...arent' we "at war"Huh??  Dirty low life criminals might face desertion charges, which is punishable by death penalty during war, isn't it?

I don't think W.VA. has the death penalty, by the way.

I don't know about more serious charges, but I have friends who were punished under the UCMJ for misdemeanors committed while on leave and on private property.  Namely an off-base civilian bar.  Said person wasn't convicted, and still awaits civilian trial.

So being punished by both UCMJ, and civilian authorities is possible.

I know for DUI's we got punished both under the UCMJ and under the laws of the state it happened in.

Go for the trifecta:

1.  UCMJ murder charges.... death penalty
2.  UCMJ desertion charges... at war, death penalty
3.  Civilian murder charges... possible death penalty

#2 could be a stretch for the death penalty.  Semantics could cause issue with us being "at war."

Local/state has primary jurisdiction. Unlikely they will pass it on.

Any known motive here?
