ObamaCare ruled unconstitutional
« on: December 13, 2010, 12:52:03 PM »
Granted, this by far is not the final word in the debate.  But apparently a federal judge in VA doesn't think ObamaCare passes the sniff test....

This judge is a Bush-43 appointee (2002) with what appears to be a fairly conservative professional history.

The best part?

In all the confusion and rush, the Democrats forgot to put in the "severability clause" into the Health Care Reform Act.  =)

What happens with Sarbanes Oxley which is now being challenged in court, and also lacks such a clause will be telling IMO.
I promise not to duck.

IMO, my gut tells me that when it reaches the SCOTUS, I suspect they'll make some pro-forma show of maintaining some parts of the law to keep Kennedy on board and make a conservative/centrist majority. Kind of like Heller.

However, between the courts, and the Republicans holding the purse strings in the House, the HCRA is on a pretty good start towards the dead-letter file.

I promise not to duck.

I don't believe it.  Ain't no way we can hop into the cess pool and come out with only some filth on one shoe.
