Summary: NY State Senator Jim Alesi injured himself when he decided to look in on the house (under construction) of a Perinton NY couple.  Since the front door was locked, he was cited in a sheriff's report for criminal trespass.  He allegedly went through the basement door and tried climbing a ladder to the first floor and fell, suffering leg injuries that required surgery.  He is now SUING the home owners and the builders.  Alesi claims that the builders were negligent in maintaining a safe premises.  This happened 3 years ago.

I wish the Ring had never come to me. I wish none of this had happened.

So do all who live to see such times. But that is not for them to decide. All we have to decide is what to do with the time that is given to us. There are other forces at work in this world, Frodo, besides the will of evil. Bilbo was meant to find the Ring. In which case, you also were meant to have it. And that is an encouraging thought

He's withdrawn the suit due to public uproar:

He still needs to be thrown out of office if he doesn't resign quickly enough -- have a recall election, or however they do it there.

We need to resurrect a few grand old traditions.

The problem is that public humiliation used to carry a shameful stigma and was to be avoided at all costs. Today it gets you invitations to daytime/reality TV and a book deal.

at least the republican party was able to squeeze him into acting right
It is much more powerful to seek Truth for one's self.  Seeing and hearing that others seem to have found it can be a motivation.  With me, I was drawn because of much error and bad judgment on my part. Confronting one's own errors and bad judgment is a very life altering situation.  Confronting the errors and bad judgment of others is usually hypocrisy.

What was he trying to do there? Just intrigued by the empty house and wanted to explore or was he actually trying to steal stuff?

I think the appropriate thing to do is for the defendant to break into his house, injure themselves and counter sue.
If ye love wealth better than liberty, the tranquility of servitude better than the animating contest of freedom, go home from us in peace. We ask not your counsels or your arms. Crouch down and lick the hands which feed you. May your chains set lightly upon you, and may posterity forget that you were our countrymen.

Has he named the friends?  If he is not up front and open about it, it makes me wonder who the friends were.

So, could he still be sued for a frivolous lawsuit?
