Maybe, but it'd doubtful they'd be able to identify anybody. They'd have to try to sue the police for not keeping the crowd from throwing stuff at their van.

Ah, but the courts have held that the police are not required to protect anybody in particular . . .

That may be satisfactory in the case of some protests.  When people are disrupting a funeral, however, "just ignore them" is a callous answer indeed.  Such things are not a matter of First Amendment rights.

I'm not a lawyer, but something tells me any lawsuit they attempt will result in major problems for them. The whole "inciting a riot" thing sounds really nice as a charge leveled to counter any such suit...

If I am crazy with grief and at a funeral of a loved one, and these demons show up and I bite the nose
off one, then I am guilty of assault or mayhem or something.

If the State says westboro can not protest then it's a free speech issue.

If they get brained with a rock it's a criminal matter.
