Today CRPA is happy to announce the filing of the opening brief in Sanchez v. Bonta, a case challenging California’s total ban on suppressors. The brief was prepared by CRPA lawyers working alongside the law firm of Cooper & Kirk.

The lawsuit will decide the critical question of whether suppressors are “arms” in the Ninth Circuit, and thus subject to the full historical analysis laid out in Heller and Bruen.

Mr. Sanchez’s lawsuit began because he wanted to create and use a 3D-printed suppressor, so he applied for federal authorization to do so, but was denied because suppressors are illegal in California. He filed suit, but the district court dismissed the complaint with prejudice, erroneously concluding that suppressors are not “arms” protected by the Second Amendment because they are not themselves weapons, nor are they essential to the operation of a firearm.

Mr. Sanchez appealed, and after briefing was completed, on February 3, the Ninth Circuit issued an order stating that it was inclined to appoint pro bono counsel to represent Mr. Sanchez in his appeal and set a new briefing schedule. Rather than have an inexperienced court-appointed attorney take on this critical case, CRPA lawyers reached out to Mr. Sanchez to offer their assistance, as did the law firm of Cooper & Kirk.

Our brief argues that suppressors are extremely popular in most states, where they are legal so long as they are federally registered. The Federal Government itself has described suppressors as the only truly effective means of preventing hearing damage while using a firearm, and Californians should get that benefit too. More importantly, the district court erred because suppressors are plainly “arms” under the plain text of the Second Amendment, which covers “all instruments that constitute bearable arms”, and not just the part of a gun that fires.

We hope that the Ninth Circuit will see things our way.

Ave Maria School of Law senior fellow Mark Smith says courts are abandoning the Second Amendment by not protecting firearm components and accessories.

Five federal courts, including the usually conservative US Court of Appeals for the Fifth Circuit, have upheld restrictions on making or purchasing silencers for firearms since 2018. These decisions could greenlight gun-grabbing regulations across a variety of components—sights, optics, stocks, and trigger guards—needed for the full exercise of one’s right to bear arms.

US Supreme Court Justice Clarence Thomas once called the Second Amendment a “constitutional orphan,” referring to lower courts consistently refusing to give it due deference as an enumerated right. Meanwhile, the Fifth Circuit in February joined four other courts in repeating the mistake Thomas identified in 2018 and left components essential to gun rights unprotected.

The Second Amendment must be read to protect guns themselves, as well as related items inherent to their safe and proficient use, such as noise suppressors.

The statute in question here requires owners to register and pay a tax on their noise suppressors with the Bureau of Alcohol, Tobacco, Firearms, and Explosives. It raises its own interesting constitutional questions, but courts have skirted around analyzing those, preferring to explore whether the components themselves enjoy Second Amendment protections. The dangerous and inexact logic of these holdings is that certain components of firearms aren’t protected by the Constitution.

In the most recent of these decisions, United States v. Peterson, the Fifth Circuit held that noise suppressors aren’t protected by the Second Amendment because “a suppressor, by itself, is not a weapon.” The three-judge panel went on to write that “while possession of firearms themselves is covered by the plain text of the Second Amendment, possession of firearm accessories is not.”

The Fifth Circuit’s conclusion runs afoul of the US Supreme Court’s language in N.Y. State Rifle & Pistol ass’n v. Bruen providing that, “even though the Second Amendment’s definition of ‘arms’ is fixed according to its historical understanding, that general definition covers modern instruments that facilitate armed self-defense.”

Noise suppressors are instruments that facilitate armed self-defense. A law that restricts the possession or use of firearms capable of firing suppressed rounds is a restriction on that category of “arms.”

Criminal defendant George Peterson asked the court on March 5 to rehear its decision en banc; the next day, the court ordered the government to respond by March 17. Acting US Attorney for the Eastern District of Louisiana Michael Simpson initially affirmed the panel’s interpretation of our nation’s gun laws, questioning whether a “pillow or a plastic soda bottle taped to the barrel of a firearm” when used to reduce noise “too, become weapons.”

According to the Department of Justice and the ATF, the answer is a resounding “yes.” Any object—pillow, soda bottle, or otherwise—when used “for silencing, muffling, or diminishing the report of a portable firearm” is considered a suppressor and, by extension, a firearm as explicitly defined under the National Firearms Act.

It appears that the DOJ has realized this mistake. On March 20, it filed a subsequent motion requesting the court delay its ruling while the government reconsiders its position on Peterson’s request, citing President Donald Trump’s executive order protecting Second Amendment rights.

It’s exactly this loose thinking that is a gift to gun restriction advocates. Many components or parts that courts have wrongly characterized as “accessories” aren’t strictly essential for a firearm to “go bang,” but are nonetheless essential to the exercise of the Second Amendment.

The straightforward application of this logic could allow the government to ban popular components that are important to gun owners, including triggers, scopes, or sights of any kind. At the very least, it opens the door to questionable regulations that make suppressors and other components unreasonably difficult and expensive to obtain.

Banning components and accessories substantially infringes on Second Amendment rights. Take scopes, for example. Roughly 11 million Americans hunt deer every year, according to the National Deer Foundation. Deer hunting is usually done at distance, with skilled marksmen felling the animal from hundreds of yards away. A scope is necessary for accuracy. But, following the Fifth Circuit’s approach, scopes don’t enjoy Second Amendment protection because a scope “by itself, is not a weapon.”

Scopes are only one component that improves the safety and functionality of firearms. Recoil pads make guns comfortable to use, especially for younger and older shooters. Muzzle brakes serve a similar purpose. Safeties disengage a firearm that is otherwise ready for use. And so on.

Suppressors are similarly important. Responsible gun owners mitigate noise to protect their hearing and as a courtesy to others. Nearly every range in this country requires ear protection as a condition of use.

At a range, the best hearing protection is to use both a suppressor and ear protection because a “silencer” doesn’t really silence the report of a firearm, it merely reduces the noise. In self-defense scenarios, few ear protection systems are as effective as a suppressor. It is both strange and inconsistent with precedent for courts to hold that components, which make guns safer and more functional, don’t enjoy constitutional protection.

There is little hope of a successful appeal to the Supreme Court unless the full Fifth Circuit or some other court breaks with the emerging consensus and affords suppressors the protection they are due.

Under Trump, the DOJ should reverse course, request the court grant Peterson’s petition for rehearing en banc, and follow through on Trump’s promises to be a champion for Second Amendment rights. Regardless of what DOJ decides, the Fifth Circuit should rehear the case to correct its mistake.

The Second Amendment Foundation has filed a lawsuit in Denver County District Court challenging Colorado’s Proposition KK as an unconstitutional tax on the exercise of a fundamental constitutional right.

Joining SAF in Langston v. Humphreys are the National Rifle Association, Firearms Policy Coalition, Magnum Shooting Center of Colorado Springs, the Colorado State Shooting Association, and a private citizen, Zachary Langston. They are represented by attorneys David H. Thompson, Peter A. Patterson, William V. Bergstrom, Athanasia O. Livas, Julian R. Ellis, Jr. and Michael Francisco.

Named as defendants are Heidi Humphreys, executive director of the state Department of Revenue and Michael J. Allen, district attorney of El Paso County, in their official capacities.

SAF and its partners contend that the state’s 6.5% excise tax on the retail sale of any firearm, firearm precursor part, or ammunition is unconstitutional in that it impermissibly singles out the exercise of a constitutional right for special taxation. There have been several rulings by the U.S. Supreme Court prohibiting such a tax scheme.

“Colorado’s new law impermissibly taxes an enumerated constitutional right,” said SAF Executive Director Adam Kraut. “Not only does the tax lack any basis in our nation’s history and tradition of firearms regulation, it violates Supreme Court precedent that states the exercise of constitutional rights cannot be targeted through taxation. We look forward to vindicating the rights of all Coloradans who are affected by this egregious attempt to chill the exercise of Second Amendment rights.”

“Federal legislation to prevent this sort of tax was introduced just days ago in both the House and Senate,” noted SAF founder and Executive Vice President Alan M. Gottlieb. “They’re calling it the Freedom from Unfair Gun Taxes Act, and greedy, anti-gun lawmakers in Colorado are probably at least partly responsible for such a bill on Capitol Hill. You simply cannot tax the exercise of a constitutionally-protected fundamental right.”

In 2024, California implemented a new 11% excise tax on firearms and ammunition to discourage the purchase of firearms and fund gun control programs. Colorado is set to implement a 6.5% excise tax in April 2025. Maryland, Vermont, New York, Massachusetts, Washington, and New Mexico have proposed similar taxes.

Issa, Hudson and Risch are joined by Congressman Doug LaMalfa (CA), U.S. Senators Mike Crapo (R-Idaho), Marsha Blackburn (R-Tenn.), Bill Cassidy (R-La.), Kevin Cramer (R-N.D.), Steve Daines (R-Mont.), Deb Fischer (R-Neb.), Lindsey Graham (R-S.C.), John Hoeven (R-Mont.), Cindy Hyde-Smith (R-Miss.), Jim Justice (R-W.Va.), James Lankford (R-Okla.), and Pete Ricketts (R-Neb.) in introducing the legislation.

The Freedom from Unfair Gun Taxes Act has received support from the Congressional Sportsmen’s Foundation, National Shooting Sports Foundation (NSSF), and National Rifle Association (NRA).

“There is a growing effort among states to levy excise taxes to discourage firearm ownership. California and Colorado have already implemented a gun tax to fund their gun control efforts and dismantle the Second Amendment,” said John Commerford, Executive Director of the NRA Institute for Legislative Action. “Senator Risch’s bill would prevent these blatant and egregious attacks on the rights of Americans, and the National Rifle Association is proud to support this legislation.”

The U.S. Justice Department’s Special Litigation Section describes itself merely as one of several sections working within the Civil Rights Division.

In truth, they are much more than that.

The Special Litigation Section was created to protect people in several areas, including those in jails or prisons, individuals with disabilities, confined youth and “people who interact with state or local police or sheriffs’ departments.”

This last bit is why Attorney General Pam Bondi told the Justice Department to investigate the Los Angeles Sheriff’s Department for violating their residents’ Second Amendment rights. The DOJ will definitely send in its Special Litigation Section. They are pros at investigating cops, and Bondi hinted they may have more agencies to review ...

Bondi was very clear about the allegations she believes were committed by the LASD. Their deputies can take more than 18 months to process concealed handgun license applications. She pointed out that the U.S. Supreme Court has strengthened the Second Amendment, which it considers a “fundamental, individual constitutional right,” but the LASD still has issues ...

How LASD’s Sheriff Luna will respond is not yet known, but it may be difficult for him. The best advice is to quickly realize he is no longer in charge. The DOJ is. Hopefully, he will stop his deputies from depriving residents of their Second Amendment rights.

If Sheriff Luna doesn’t act soon, he may become just another unemployed top lawman who lost his job because he underestimated the Justice Department’s little-known but powerful Special Litigation Section.

WASHINGTON, D.C. — The Department of Justice and the Bureau of Alcohol, Tobacco, Firearms and Explosives announced today the repeal of the Enhanced Regulatory Enforcement Policy and the review of Final Rule 2021R-08F, related to stabilizing braces, and Final Rule 2022R-17F, related to the definition of “engaging in the business” of firearms dealing.

The Enhanced Regulatory Enforcement Policy, aka the Zero Tolerance Policy, was a strategy announced in 2021 that set more stringent criteria for Industry Operations compliance inspections to identify licensees with certain qualifying violations. As of today, this policy will be repealed, and Industry Operations inspections will no longer be held to these previously set guidelines.

Additionally, DOJ and ATF have plans to revisit the regulatory framework surrounding stabilizing braces (Final Rule 2021R-08F) and the definition of “engaged in the business” of firearms dealing (Final Rule 2022R-17F).

“This Department of Justice believes that the 2nd Amendment is not a second-class right,” said U.S. Attorney General Pamela Bondi. “The prior administration’s ‘Zero Tolerance’ policy unfairly targeted law-abiding gun owners and created an undue burden on Americans seeking to exercise their constitutional right to bear arms – it ends today.”

“Today’s repeal of the Zero Tolerance Policy and the comprehensive review of stabilizing brace regulations and the definition of ‘engaged in the business’ marks a pivotal step toward restoring fairness and clarity in firearms regulation,” said Acting ATF Director Kash Patel. “We are committed to working with all stakeholders to ensure our policies are balanced, constitutional and protective of Americans’ Second Amendment rights.”

The decision to review the Stabilizing Brace rule, which sought to reclassify certain firearms as short-barreled rifles, as well as revising the guidelines for determining who is considered "engaged in the business" of selling firearms, reiterates constitutional approaches to firearm regulations.

The DOJ and ATF will conduct an in-depth review over the coming months and will engage in consultations with stakeholders, including gun rights organizations, industry leaders and legal experts. Further updates on the status of these reviews will be released in due course.

Background

- We submitted a report to the White House and DOJ outlining numerous positive key reforms that the Trump Administration can enact to address unconstitutional and burdensome rules, regulations, and enforcement practices.

- On February 7, President Trump issued a landmark executive order that directed the Attorney General to “examine all orders, regulations, guidance, plans, international agreements, and other actions of executive departments and agencies (agencies) to assess any ongoing infringements of the Second Amendment rights of our citizens, and present a proposed plan of action to the President, through the Domestic Policy Advisor, to protect the Second Amendment rights of all Americans.”

- In our most recent meeting this past week, White House staff confirmed that many of our proposals are being strongly considered and confirmed their willingness to entertain additional suggestions.

What We’re Working to Achieve

Among numerous other proposed reforms, FPC is encouraging the White House and DOJ to:

1. Establish a Second Amendment Czar – A dedicated official to coordinate and implement the Administration's pro-rights policy agenda across the executive branch, from DOJ criminal prosecutions to civil litigation, the ATF, Department of Commerce, and more, to ensure that all federal departments and agencies are aligned around protecting the right to keep and bear arms. This role would also serve as a liaison to ensure Second Amendment concerns are consistently addressed at the highest levels.

2. Create and Staff a First and Second Amendment Section Within the DOJ’s Civil Rights Division – A specialized section within the DOJ dedicated to addressing and litigating against unconstitutional laws, policies, and practices of state and local officials that violate the right to keep and bear arms and free speech. This is particularly important to residents and visitors of jurisdictions that are openly hostile to free speech and the Second Amendment, like California, New York, New Jersey, Massachusetts, Maryland, Connecticut, Hawaii, and others.

3. Enact Massive National Firearms Act (NFA) Arms Reforms – A comprehensive review and modernization initiative to remove or update outdated rules and processes, increase access to NFA-regulated arms, and speed processing with point-of-purchase processing and virtually instant background check responses, among other things.

We have just filed a motion to stay the mandate in Duncan v. Bonta. Without getting too into the weeds, the basic goal here is to protect "freedom week" and grandfathered magazines while we seek cert from the Supreme Court. Since 2019, magazines possessed before the complete ban law and a result from freedom week have been shielded from enforcement of the general ban by an order from Judge Benitez. Mandate issuing would ultimately reverse that order, and it would no longer be legal to possess such magazines. Thousands of law-abiding Californians would be turned into criminals. 
 
The State did not oppose this motion, so we expect and hope it will be granted. Then, our fate relies on the Supreme Court doing the right thing and reversing the en banc majority's erroneous ruling.

No news yet ... My guess is likely another relist.

And in the meantime, Duncan v Bonta (CA Magazine ban) is headed to Supreme Court after 9th Circuit merits decision (Not interlocutory) for majority justices to grant cert.

... President Trump has made protecting the Second Amendment rights a priority for this administration. As he explained, "[t]he Second Amendment is an indispensable safeguard of security and liberty," because it "is foundational to maintaining all other rights held by Americans." Executive Order 14206 § 1 (Protecting Second Amendment Rights). Our motion to stay the mandate in Duncan v. Bonta was granted. That means magazines possessed as a result of "freedom week", or magazines possessed before the possession ban was enacted, are protected until the Supreme Court decides what to do with the case following our upcoming cert petition.

CRPA sincerely hopes the Supreme Court will finally do its job and confirm that the magazines California seeks to ban are protected arms.

We received the following letter from LAPD Chief Jim McDonnell in response to our letter warning them of upcoming litigation due to their two-year wait times for a CCW permit.

While we appreciate that Chief McDonnell says he wants to find solutions, what he reports is actually quite distressing.

For example, he seems to be proud that LAPD issued about 1,500 CCW permits in 2024. But in a city of 3.8 million people, that pace is simply much too slow, so it's no wonder wait times have stretched to 24 months. While they process 150 new permits per month and 50 renewals, they get 500 interested applicants. That math means the wait times will only grow.

CRPA will demand a commitment to a firm timeline for LAPD to get their house in order and process permits within 120 days of receiving them. If LAPD will not make that commitment, then litigation will follow.

Whatever resources or new hires it takes, LAPD needs to get it done. If the government wants to insist that people have a permit to exercise a constitutional right, then the government cannot also complain that its workload to process permit applications is too overwhelming.

We encourage LAPD to persuade its allies in the state legislature to simplify the permit process to match that of nearly every other state, and to extend the duration of CCW permits such that they do not need to be renewed every two years, which would ease the burden on both applicants and the departments processing these applications.
