Did VanDerStok ruling expand Heller/Caetano in defining "arm" to expand Second Amendment protection?

Supreme Court has been ruling to settle court splits and what is constitutional to set precedents as the highest court of the land.

Precedents were set in Heller that Second Amendment protection applied to modern arms that were not in existence at the time of founding in common use inside the home for self-defense unrelated to militia service, in Caetano to non-propellant/projectile based modern energy arms in common use, in Bruen to modern bearable arms outside of home for self-defense eliminating interest balancing greater good of society (mass shootings, etc.) approach with burden shifting to the government/states and in Rahimi reaffirming Bruen test/methodology of "text, history and tradition" with burden of providing historical evidence for firearm regulation analogue shifting to government/states.

And now with VanDerStok ruling, Second Amendment protection was reaffirmed to "artifact noun" produced by modern forms of manufacturing (3D printing, etc.) rapidly proliferating to become in common use that is evolving into metal 3D printing which allows individuals to create affordable and reliable "artifact noun" at home.

What is "artifact noun"?

On page two of VanDerStok Supreme Court majority opinion, we find,

"SENSITIVE PLACES" EXPLANATION. I wrote this to a Four Boxes Diner fan so I thought I would post it here too! This explains when government can ban guns in a specific location consistent with 2A based on US's historical tradition of gun regulations.

In short, if a government does not provide comprehensive security with limited points of entry, metal detectors and armed guards, then it cannot be a constitutionally-acceptable government-mandated gun free zone. The only time the government can take away your fundamental 2A right to keep and bear arms in a specific location is when the government itself assumes the full responsibility for protecting you with armed defense; short of this, you have a right to protect yourself.

If you look at our Founding history, the three "sensitive places" mentioned in Bruen (polling places, legislative chambers and courthouses) all had armed guards. Sheriffs, sergeant at arms, and bailiffs. 

Today, with the rise of small, concealable handguns (less of a problem at the founding where everyone carried unconcealable rifles/shotguns/long guns), to have comprehensive security, the gov't must provide metal detectors and limited entry points in addition to armed guards.  At the founding, you did not need metal detectors b/c the main weapons were big and not concealable. Today, with handguns being ubiquitous, you need the metal detectors for comprehensive security, which is what we see at airports, courthouses and Congress.

Note, the government does NOT have to provide comprehensive security at a location. However, if they want to ban guns in a location, then they MUST provide comprehensive security.  No government-provided armed security means the government cannot deprive you of your 2A rights. 

Finally, the practical benefit to the comprehensive security approach to the "sensitive places" question is it is an objective test: has the government ACTED to make a place "sensitive" or have they just paid lip service to the question by labeling a place as "sensitive" without treating it as such. If the government has not provided the same level of security as is provided by the government to protect the judges in a courthouse, then it is not comprehensive security and, by extension, a gun ban would not be constitutional in that specific location.

I have cosponsored @Rep_Clyde's bill to remove suppressors from the National Firearms Act.

These helpful hearing protection devices aren't regulated at all in countries like New Zealand & South Africa and shouldn't require a $200 tax stamp.

The Hearing Protection Act (HPA) and the Stop Harassing Owners of Rifles Today (SHORT) Act have stalled in the House of Representatives Ways and Means Committee.

The HPA (H.R. 404) would remove suppressors from the National Firearms Act of 1934 (NFA). Currently, suppressors must be registered with the Bureau of Alcohol, Tobacco, Firearms and Explosives’ (ATF’s) NFA Division, and the owner must pay for a $200 tax stamp. Suppressors will remain a Gun Control Act of 1968 (GCA) item, meaning a single Federal Bureau of Investigation (FBI) National Instant Criminal Background Check System (NICS) check would be needed to acquire the item. They would be treated like any other firearm. The SHORT Act (H.R. 2395) would remove short-barreled rifles (SBRs) from the NFA.

The Ways and Means Committee is headed by Jason Smith (R-MO). The Committee is holding up both pro-gun bills from passing out of committee. The majority of the Committee is comprised of Republicans, and the bills should be passed with a slam dunk, but three different scenarios could play out in the committee.

The first option is the HPA, and the SHORT Act can pass out of the Committee unchanged. Most gun owners have been begging Congress to pass this option for years. The deregulation of suppressors and SBRs would be the most significant Second Amendment win through Congress in years. The Republicans can cement themselves as the true defenders of gun rights, something many within the 2A community have doubted.

The Committee’s second option is to modify the bill’s language to keep suppressors and SBRs on the NFA, but lower the tax stamp fees. Although this would be better than the current $200 fee, the majority of gun owners would only be satisfied with the total delisting of suppressors and SBRs from the NFA. Most will accept nothing other than the complete delisting of SBRs and suppressors from the NFA. Some Republicans on the committee might see the lowering of fees as a victory, but many think they will become pariahs in the gun community.

The third option is not to pass the bill out of the House Ways and Means Committee. With the majority of Republicans in control, this is the least likely outcome, although Brian Fitzpatrick (R-PA) has taken extreme gun control stances in the past, including advocating for an “assault weapon” ban. Although it has not been confirmed, most expect Fitzpatrick not to back any bill restoring gun rights. Luckily for gun owners, most Republicans do not take such an anti-2A stance.

Other members, such as Blake Moore (R-UT), have not indicated how they will vote. These Representatives have faced massive pressure from gun groups such as Gun Owners of America (GOA), who put out a call to their members to contact their reps to push through the full HPA and SHORT Act without stripping anything out of the bills. According to sources on the Hill, the members of the House Ways and Means Committee have had their phones ringing off the hook, with gun owners encouraging them to advance the two bills as is.

The bills’ markup is scheduled for Tuesday. According to House rules, a draft markup must be presented by Sunday night. The window is closing for gun owners to make their voices heard. Gun-owning Americans are making a difference in the fight over the bills’ language, and pro-gun groups are asking the gun community for one last push.

- You apply the Heller/Caetano precedents, you apply the "in common use" test, you find that semi-automatic rifles are in common use by Americans for lawful purposes ... it's not even a debate
- ... If the Supreme Court were going to rule that a gun ban was appropriate on some commonly owned firearm, the handgun would have been the more logical way to go but they found that handguns were protected under the Second Amendment ... in Heller
- ... So therefore it seems very straightforward that the Supreme Court should find that AR-15 semi-automatic rifles, AK-47s should readily be protected
- Now beyond the Snope case, we also have the Ocean State Tactical case out of Rhode Island ... large capacity magazine ban ... on a preliminary injunction
- ... as a general matter [SCOTUS] don't like to hear cases on an interlocutory basis
- ... there's much more likely to grant cert in Snope and then put on the shelf the Ocean State Tactical case and then send them back down after a decision in Snope for further consideration by the lower courts
- What could happen is they could grant cert to both cases but I don't think that's going to happen
- I think they would grant cert to Snope
- ... what's going on with Supreme Court relisting cases ... for a case to be relisted ... the Supreme Court will set a conference for all the justices to decide whether or not to grant cert in a case and they go back and forth
- You need four justices vote to hear the case and grant cert
- Now if the court for some reason is not able to decide right then and there, whether or not to grant cert, they want to keep thinking about it, they will relist the case for reconsideration a week or two later
- And then, if they still can't come to a decision, they will relisted again and again and again
- Now in many instances, if you see a case that's being relisted a handful of times, three or four times, what often occurs is someone has decided to write a dissenting opinion
- Why? Because perhaps at the first conference of the case, there was a decision by the Supreme Court to not hear the case ... one or more of the Supreme Court justices are like I disagree with that, we really should have heard this case
- So what happens is after the Supreme Court has decided and voted to not hear a case, before they publicly announce that they will let the justices that disagree with the decision draft a dissent
- So when down the road, several weeks or whenever Supreme Court publicly announces that they are denying cert in a case ... they will simultaneously publish with that denial of cert announcement ... they will publish ... dissent by the one or more justices
- ... in the Rogers decision, when the Supreme Court denied cert in 2020, there was a powerful dissent written by Clarence Thomas saying this is ridiculous, this is a clear case we are disrespecting the Second Amendment, we are treating it like a second class right ... we the Supreme Court should grant cert to this Rogers case and for once and for all decide that the right to bear arms means the right to carry guns in public for self-defense
- ... Snope case now passed a handful of relistings, a handful of multiple conferences ... we are now at the point where there have been 13 ... relists which means 13 conferences ... and still no decision to grant cert to deny cert
- Now ... Supreme Court ... could very well do one of two things ... either grant and hear the case of Snope which is what they should do or grant cert but then issue what's known as a percurium decision which is what ... they did in 2016 in the Caetano versus Massachusetts case ... stun guns
- ... I should note that ... Supreme Court decision that overturned Roe v. Wade was relisted 12 times before being granted and the Masterpiece Cake Shop was relisted 14 times before cert was granted
- ... I think the record for relists before a case was decided is 23 ... there was a per curium decision
- I think overall in terms of Snope, we still got our fingers crossed ... I'm still cautiously optimistic good things are going to happen
- It's been a long time and I don't see why they keep dragging their feet if they're just going to deny cert
- So every day we're still alive with Snope and Ocean State Tactical I think is a good day
- Let's hope they grant cert ... they really should
- And the fact that the Trump administration solicitor general John Sauer and Harmy Dylan over there at civil rights submitted a brief to the Supreme Court urging them to start
taking more Second Amendment cases, I think is a positive big time with the Supreme Court

Ownership for a Washington state resident is no problem for any mags owned before the ban.  In Washington, you cannot carry into the state any mags of more than 10 round capacity.  That is considered 'importing' which is expressly forbidden by the law: https://app.leg.wa.gov/RCW/default.aspx?cite=9.41.370

Violation of the law is a gross misdemeanor, but having said that, there are no checkpoints at the state border.  I have read that the Cabela's in Post Falls will not sell you standard capacity magazines if you are a Washington resident.

One reader pointed out that suppressors are safety devices for the ATF but are considered a privilege for those of us who aren’t ATF agents. Unfortunately, he is 100% correct. The ATF is completely wrong in its reasoning. 

We can all agree that suppressors offer a tremendous boon to health and safety, but shouldn’t civilians receive the same benefits as our lowliest federal agents? We should be able to purchase them anywhere, anytime we want, without any federal forms, waiting periods or especially $200 fees. 

Doesn’t the American public deserve the same level of health and safety that ATF agents receive, especially since we’re already funding theirs through our tax dollars? 

If the ATF is correct and suppressors are true health and safety devices, why isn’t there one included in the box with every new gun purchase? The ATF already requires gunmakers to include padlocks and keys with every new sale. Why not suppressors, too? 

Why do American citizens have to take second place to federal agents?

Don’t we have the same right to safeguard our own health and safety? 

H.R.404 – Hearing Protection Act

Just four months ago, Congressman Ben Cline (R-VA) reintroduced the Hearing Protection Act (HPA), which was designed to reduce “the overly burdensome barriers required to purchase a firearm suppressor to ease access for law-abiding citizens simply trying to obtain the hearing protection they need.”

“Americans who enjoy hunting and target shooting should be able to do so safely and legally without facing burdensome government regulations,” Rep. Cline said. “The Hearing Protection Act will reclassify suppressors, making it easier for law-abiding gun owners to protect their hearing while enjoying recreational activities. It’s time to ensure that our Second Amendment rights are upheld, allowing responsible citizens to enjoy their freedoms without unnecessary obstacles.”

As it stands now, Cline’s bill has 76 cosponsors, and every single one is a Republican. The bill was assigned to the Committee on Ways and Means, and the Committee on the Judiciary, for a period of time that will be determined by the Speaker of the House,

The bill drew strong support from the gun community, including the American Suppressor Association (ASA), the National Shooting Sports Foundation (NSSF), the National Rifle Association (NRA), and the Congressional Sportsmen’s Foundation (CSF).

While representatives from all of the organizations were quoted in the bill’s press release, no one said anything better or more relevant than Lawrence G. Keane, NSSF’s senior vice-president and general counsel.

“Congressman Cline’s Hearing Protection Act will have the federal government recognize firearm suppressors for what they are. These are accessories to a firearm that make recreational shooting and hunting a safer experience,” Keane said. “These safety devices reduce the report of a firearm to a level that won’t cause instant and permanent hearing damage. Despite Hollywood’s depictions, they do not mask the sound of a firearm. The focus should be on removing barriers to safe and responsible use of firearms and dedicating resources to ensuring firearms are safeguarded from those who should never possess them. Strict regulatory control of firearm accessories, and the parts of those accessories that have no bearing on the function of a firearm, is unnecessary and not the wisest use of federal resources. AmmoLand News has been provided with the name of the lobbyist pushing for a fee reduction instead of elimination from the NFA by our sources inside the House Ways and Means Committee.

It is a name that should be familiar to most in the gun rights community….

Heavy lobbying is being done by the former head of the National Rifle Association’s Institute for Legislative Action (NRA-ILA), Chris Cox, a paid lobbyist. Cox is working to lower the tax stamp fee to $5 and keep suppressors on the NFA!

The current NRA-ILA has pushed for the removal of suppressors from the NFA, and Cox’s actions are contrary to that stance. Mr. Cox no longer has any connections to the NRA. Mr. Cox has also lobbied for a gun company that produces suppressors, which has strongly advocated removing silencers from the NFA, and could make millions of dollars if the hearing protection item is delisted from the NFA.

It is unclear if Chris Cox is advocating for a specific client of his lobbying firm, Capitol 6 Advisors, or if this is a personal issue for him, but Cox seemed to back a rule banning bump stocks under Trump’s first term while heading the NRA-ILA.

“What we’ve said has been very clear: that if something transfers a semi-automatic to function like fully automatic, then those should be regulated as well,” said Chris Cox in a Fox News 2017 interview.

Fast forward to 2025, and a less friendly gun stance would not be out of the norm for Cox, who claims to be a freedom fighter.

The question AmmoLand News is asking is who, if anyone, is paying for the lobbying. AmmoLand News is getting close to that answer, but has not been able to get confirmation of the rumors we are hearing.

Eliminating suppressors from the NFA and reducing the tax fee could both appear as separate provisions in the final markup. If the bill passes the House, the Senate will determine which version to adopt if that happens. While this isn’t the ideal outcome, it’s far better than having the language removing suppressors from the NFA excluded entirely, leaving only the lesser $5 tax stamp option on the table.

At this late date, phone calls are best.

I presume they think lowering the tax is a goal that is actually archivable (maybe).

Consider if the tax is eliminated, that will open up millions of more potential customers for suppressors.... soon they will be mainstream in every way.

And then it would be easier to get them off the NFA.

Unless the Senate Parliamentarian has opined in writing that removing suppressors from the NFA would NOT be subject to the budget Reconciliation process, suppressors should be removed from the NFA. The main NFA problem is the REGISTRY, and not the de minimis tax.

I suspect removing suppressors from the NFA would fall squarely within Reconciliation. The NFA is a taxation scheme so changing the NFA (adding, subtracting, modifying) would be the same as amending the income tax code. With Reconciliation, you avoid Democrat Senate Filibuster
