[If] gun owner hadn't asked the ATF a question....really why poke the bear, the injunction is in place you don't need to go asking questions.
Likely some "law abiding" gun owner wanted to do the right thing and comply with current status of pistol brace rule by asking the ATF, to be sure and get it right from the "horse's mouth".

And instead of "complying", ATF defied the court injunctions and stated to the gun owner that adding a pistol brace to the CZ Scorpion pistol would result in SBR. 

ATF could have "complied" with court injunctions and stated to the gun owner court injunctions kept ATF from enforcing the pistol brace Rule and depending on the outcome of the legal challenge, whether braced pistol remain pistol or become SBR could change.

Even for "defiant" CA attorney generals Becerra/Bonta, they complied with district court judge Benitez rulings under Duncan case to allow immediate importation and sale of larger than 10 round capacity magazine until ruling was stayed; and under Boland/Renna preliminary injunctions, allowed addition of "unsafe" handguns to the CA handgun roster - https://armedpolitesociety.com/index.php?topic=70249.msg1461226#msg1461226

So the GOA member did nothing wrong rather ATF did the wrong doing.

Do not ask the ATF for opinion letters.  We should have learned that lesson by now.

Those letters are not binding on the ATF, and bring up more restrictions most of the time.  The ignorant "law abiding" gun owners had nothing to gain, and plenty to lose.

Things should not be that way.

When I worked for three CA state government agencies, two of them being enforcement agencies, while I could not provide direct guidance to facilities, during surveys and complaint investigations, if staff asked for guidance on how to fully comply with applicable regulations, I told them while I was not allowed to provide guidance answers for compliance, I was allowed to share examples of how other facilities met compliance (Essentially giving them the answers to the test) and that was very much appreciated.

Regulatory agencies exist as extension of executive branch and should be working to benefit "We the People".  I, along with most in the two agencies felt we did not work for the government rather "We the People" to keep them safe from corporations, companies and individuals who intended to harm/take advantage of "We the People".

To this retired civil servant, ATF along with other federal executive agencies should also work to benefit "We the People" instead of treating us law abiding citizens as criminals.

And I sure hope things change for the better in the next four years. =D

I'm sorry to be such a Debbie downer, but that kind of delusional optimism is how people end up asking questions of the feds, and fuck8ng things up.

We are doing well in court lately, and orgs li,e FPC are making real strides in forcing the government to back off, as your other thread exhaustively documents.

But you're high if you think Congress is repealing GCA or deauthorizing the ATFE.

But it sure sounds and feels good to say "Abolish the ATF".  :rofl:

My take is 2025-2028 with Republican control of House/Senate with Trump in the White House FOLLOWING many failures and unconstitutional rulings by the Supreme Court that definitely have angered "minority" gun owners which has become the latest protected group with changing gun culture, many in younger generations along with LGBTQ/feminist seeking personal protection are joining this "minority" group.

So now is perhaps the best time to push to reform/reorganize ATF under the banner of "Abolish the ATF" with majority of Republican senators and representatives supporting.  And who knows, Elon/Vivek and Trump's cabinet could reveal/uncover things to enhance "Efficiency" of ATF core functions.

We can dream, right? 

Maybe this time around, our elected representative may/could surprise us? =D

It sure does seem like gun owners and gun rights groups are in a stronger position than they have been in a while. 

Amazing what can be done when the largest gun owners group (NRA) isn't working against us (I think) and other groups are being aggressive with lawsuits and such.
