More health issues for Justice Ginsburg.
She is a tough one, I can see how she made it as far as she has.
Tenacious

I certainly don't wish anyone ill health and hope she recovers fully for her friends' and family's sake. Professionally, however, it may be time to hang up the gavel.

This is the kind of thing where I don't care about politics. If this were Justice Thomas and Hillary Clinton were President, I would still say "retire". People deserve some dignity in their remaining years. I wouldn't want to see anyone hold that position until death or a different president simply to make their political wing happy.
The needs of the one outweigh the needs of the few, or the many.

I call BS
U.S. Supreme Court Justice Ruth Bader Ginsburg has had a re-occurrence of malignant melanoma, she has told her law clerks
Malignant melanoma is skin cancer, RBG has fought lung, colon and pancreatic cancers. No mention of skin cancer in the past.

If that's true, the Kavanaugh confirmation circus will look like tea with the queen, by comparison. I hope he nominates keg-quaffer Kavanaugh to that seat as well.

Her lung cancer is back.

Yup, multiple mainstream sources are reporting lung cancer.
-
Her lung cancer is back.
Right, but I'm calling retirement in Jan 2019 BS, because of the wrong cancer mention in the article I pulled the quote from.
I'm not doubting she just had lung cancer removed.

Yeah, no lame stream media reporting her retirement just yet.
Mattis for USSC. >:D [popcorn] >:D [popcorn] >:D

Mattis for USSC. >:D [popcorn] >:D [popcorn] >:D
The fits of apoplexy on the left if that were to happen would cause even my cold evil conservative heart to warm... Not that I really could opine on whether he would make a good judge (although it would be entertaining as hell to have him go all "drill sergeant" on the other members of the court), but just for the sheer volume of screeching from the libprogs.

Trey Gowdy, Ted Cruz, Mike Lee would all be good choices, but I also think Ms. Barrett will do just fine.

I think his theatrics for attention would not make him a credible justice. This isn't a John Grisham novel turned into a movie, but the SCOTUS.

Understand what he (and congress) can and can't do. Congress can't file charges, nor prosecute anyone. All they can do is bring wrong-doing to the attention of the FBI and DOJ. It's up to them to go after the wrong do-ers.
The whole Hillary e-mail investigation came about because of Gowdy's Benghazi hearings.

There were several witnesses (I don't remember exactly who) that should have been arrested on the spot for "civil contempt" and thrown in the Capitol dungeon. They do have that power, they just never use it.

And has anyone even ever been "brought to the attention of the DOJ/FBI?"
They have a bully pulpit refer them to the DOJ and if the DOJ does nothing refer the DOJ to the people that pay their salaries.
I will concede that all the dog and pony shows have shown us that our government "officials" are above the law and unaccountable to anyone and the crooks on the left can pretty well do anything they want with impunity.
-
The poor woman should retire and try to relax in what time she has left. Perhaps she can finally make that trip to New Zealand she & her husband were considering in case of a Trump win back in 2016 . . .
Trey Gowdy, Ted Cruz, Mike Lee would all be good choices, but I also think Ms. Barrett will do just fine.
NOT Gowdy - he made a lot of noise which made for good political theater, but nothing MORE than political theater; aside from some finger pointing, he was ineffectual in obtaining tangible results from the committees he chaired.
Hmmm . . . I wouldn't mind Jeanine Pirro. Though she only served as judge on a minor court (not federal) and as a district attorney, she still seems to have her head screwed on right.
But I'm sure the Democrats already have a smear campaign orchestrated against Trump's next nominee, with documents, sworn statements, and witnesses all lined up to allege corruption, sexual deviancy, pedophilia, racism, homophobia, collusion with Russia, devil worship,** and rumors of anthropophagy . . . all they have to do is wait for Trump to formally nominate someone so they'll know whose name to fill in.
** - ok, maybe not devil worship. That might gain support from a large part of the Democrat base.

Yes, Hillary was. And yes, they white-washed it and swept it under the rug. And I'm just as pissed off as you are. She was doing what she did deliberately. (Even thought the crimes she committed do NOT require intent or mens rea). You don't "accidentally" setup a private server an then "lose" 30,000 emails, then Bleachbit the damn thing so you can't recover anything. (Why has no one gone to NSA and recovered them "by other means" ??) That bitch and her entourage needs to be not in jail, but under it.
Meanwhile, if you have an "R" after you name (or are one of the "little people" of this country), get hammered for "lying to federal agent" for not recalling with surgical precision the minutiae of phone calls from months ago, but the FBI call lie his ass off and say "I don't remember" almost 300 times, and he's a hero of the #Resistance. And 100% agree with you, we need a plaque, but I'm betting we're going to get a civil war.

Hopefully she has. She mentioned opposing the mag ban in the new article you posted; no mention of a change of mind on a rifle ban though.

She will miss the upcoming oral arguments for the first time ever since becoming a SC Justice.
I’m surprised they don’t teleconference her from her home where she is still recovering from surgery.

I really wonder if it will be one of the situations where years later we will learn it was a clerk doing the final writings for someone in a coma or otherwise unable to do anything meaningful.

If so, how long can the charade go on before someone demands access to the Judge?
How can they indefinitely sequester her away from the public and colleagues pretending she is still capable of performing her duties?

I seem to recall reading about a senile SC judge years ago... his colleagues "put off" making any decisions where he would be a tie breaker. Can't recall who that was though.

yes, it seems so.
Chief Justice John Roberts announced from the bench that Ginsburg is continuing to participate from home. This is not unprecedented, as the late Chief Justice William Rehnquist also participated and even authored several opinions while undergoing cancer treatment from 2004-2005.

I think this goes here. So today I'm in my state capitol in a room full of white oppressor statues(Virginia). Tour guide asks what is the oldest continuous legislative body in the western hemisphere. My kid blurts out RBG. So should I be happy a fifth grader knows the name of a supreme, embarrassed at how wrong she was given the contextual clue, or just marvel at the snark?

Over 50 days of Weekend at RBG’s. There seems to be a media blackout on her.
On a tangential side note I ran across a story about the gay couple she performed a “marriage” for some five years ago. They have been accused of and are under investigation for drugging and raping a young man.
Love is love they say ...
-
I think the media blackout is indicative of the grave state of her health. If she were improving, or at least stable, comfortable, and talkative, the media would be all over it. My personal opinion is they aren't reporting on it because it's hard to put a positive spin on someone in critical condition.
Brad
-
I was thinking of the opposite. If we had a Democrat Pres and someone like Clarence Thomas had medical issues, there would be daily reports the street outside his home with lots of opinionators saying he should resign.

Maybe. I wonder if there is a time requirement to report someone's death. For a SCOTUS justice, I would think the news would get out fast.

Reminds me of the days in the Reagan admin, when everyone was speculating on the health of the seldom seen Leonid Breshnev.

Maybe they've used plastic surgery to artificially "age" a double, who will make her public appearance as soon as the incisions heal and the swelling goes down. Being younger (though looking older) than the real RBG she could be around for a long, LONG time.

A terrifying prospect, worthy of an S-F movie script. Well, if she suddenly turns up all hale and hearty and healthy, we'll know what the score is.

I read another story where she is back to walking a mile a day and working out with her trainer twice a week, I guess that settles that...
-
Still reminds me of Brezhnev.
Brezhnev had struggled with several ailments (https://en.wikipedia.org/wiki/Death_and_state_funeral_of_Leonid_Brezhnev#Death_and_declaration) since 1974, most notably heart disease, leukemia, jaw cancer, emphysema and circulatory disease, all of which had been exacerbated by his heavy smoking and obesity. There had been rumours of Brezhnev's death ever since the mid-1970s; he had been absent from important meetings demanded by protocol and it was rumoured that his health was in decline.[1] Brezhnev had rarely appeared in public for most of 1982 and was usually surrounded by doctors, although the Soviet Government insisted that he was not ill. He suffered a severe stroke in May 1982, but refused to relinquish office until he died on 10 November 1982 after suffering a heart attack.[2]

The articles about her read like old USSR propaganda pieces or something out of North Korea.

Ginsburg will likely not attend the State of the Union address Tuesday night as she has a history of boycotting those given by Republican presidents, reported the Washington Post, which also noted that Ginsburg’s appearance at the concert was low-key.

I think this is God's way of telling her to retire. Apparently she didn't get the hint the last few times she had cancer.
-
I think I may have mentioned it earlier in this thread, but no politics are worth staying on the job in this condition. I may not agree with her politics, but she has a right to some peaceful remaining years.
For her political concerns, she probably should have looked at retiring early in Obama's second term. If she's hanging on and suffering now, just to keep a conservative judge off the SC, she's probably doing so in vain. At this point (things can always change) Trump will almost certainly be re-elected, and I don't see the makeup of the senate changing. At best (for libs), a moderate judge will get in as her replacement.
-
She won't retire. Especially with Trump in the White House and a Republican Senate. I seriously doubt the D's can take the Senate next year. Gardner and McSally are the only particularly vulnerable R's, and Jones (AL) is unlikely to retain his seat for the D's. That would leave Senate 51R/49D even if all 3 go in favor of the Ds. So even if Trump loses next year it's not like whoever is last out of the D clowncar of POTUS candidates will be able to confirm a 45 year old ideological clone of RBG.
I'd certainly prefer to have Trump replace her with Amy Barrett though.
-
I want her replaced with another white, Catholic guy, preferably a classmate or close friend of Justice Kavanaugh.

Your comment may be accurate. But there is a difference. On arfcom it's the rabble with no bully pulpit. When it comes to LibProgDems it's the Prognoscenti, MSM, Democrat congress critters...ie: they have the bully pulpit.
I have no respect for Bader whatsoever. She trampled on the Constitution nearly every time she had a chance. She even went so far as to say that she didn't like the Constitution and would rather have the one from S. Africa. I still wouldn't wish a painful death on her. If she had any class at all, she would have retired a couple years ago.

Alito looked pretty good with the McDonald ruling but, since then, he has had some real clunkers, and IMHO has been on the wrong side too many times.

Good point.
And, of course, she would never have resigned while Bush was President.
I understand it's customary to wait until the party that appointed you holds the White House.
-
Why didn't she retire under BHO?
-
Why didn't she retire under BHO?
I don't know. Waiting for the Dems to get the Senate in 2018, after Clinton won? Or maybe she liked the idea of allowing the first womyn president to replace a female "justice" with another female/gender-fluid/Latinx "justice"? (You can't really call these Lefties justices. More like injustices. Or social justices.)
-
Why didn't she retire under BHO?
I can only imagine it was because she wanted to help cement Hillary's legacy by allowing her to appoint someone to the SCOTUS bench. The gift that keeps on giving for decades after the President that has appointed them fades into obscurity.

Or she wanted to help rubber stamp Hillary's actions in the SC.
She probably just didn't think she was ready to retire until more recently. We were one Justice short for a year or so before Trump got elected.
-
Back in the hospital with chills and fever.
-
She's been in and out a lot.
Again, not wishing ill will, but I think she might be retiring, or forced out by health before the next election. Which could be good or bad politically, because it would absolutely energize the dem base to vote for "anybody but Trump". From that perspective, if she doesn't retire before the year is out, it would almost be better that she stay in until after the election.
Non-politically, as I have said before, I wouldn't want to see anyone, whether I agree with them or not, risk their health because of a political ideology. If she's really sick and suffering, she should retire, regardless of political consequences to either side, to have some peace in her remaining years.

She should, but she's a Trump hater ... so she won't.
-
If she can just hold on until the first of the year it will open her seat and then that Republican (informal) rule of not appointing within one year of an election will come back and bite them in the ass. When will the politicians ever learn, when you change the rules for your benefit eventually it will benefit your opponents.

Just change it again.
Screw the left.
They are demonstrably a bunch of communists and sick perverts.
-
The D's are shameless about changing the rules entirely for whatever they perceive as being to their benefit. They wouldn't hesitate to fill an opening, particularly if altered the ideological balance of the SCOTUS. So why should our side?
-
I have no doubt that under similar conditions the Dems would ram through their pick.
-
I believe Trump's next pick will be Amy Barrett, but Merrick Garland would be a good nominee to replace Ginsberg.

If Ginsberg retired next year, I would much prefer Barrett, but it would be interesting to watch the dems do their dance if Trump chose Garland. I believe he would go from, "The poor guy the Rs screwed" to "evil old white man". I'd expect stuff he did in the third grade to come to light.

And that "rule" could double-screw the Rs. If they don't ram someone through, it will energize the dem base for November to keep another conservative off the court. If they do ram someone through, it will infuriate and energize the dem base into retribution mode. Which is why I am hoping (but see below) she doesn't retire next year
Strategically, I would almost like to see the "ram someone through". Presidents come and go. Maybe there's a Warren in the White House for 4 or 8 years, but there's a conservative in the SC for 20-30 years.

I don't see how a SCOTUS seat would energize one side over the other. It sure meant a lot to Trump's 2016 chances, and how Republicans have perceived his first term.
I don't think the Democrats can be more motivated to unseat Trump than they have been the past 3 years. Unless, of course, they managed to find a candidate they all actually believed in.

That's where I'm coming from on "energized". Dems don't seem to be too crazy about any of the candidates, and status quo, I could see a percentage of them staying home or voting third party/write-in. If we got a conservative justice, I think many of those people would vote for whoever gets the dem nomination.
Much in the same way I was going to do a write-in, but changed my mind at the last minute and went "Trump" because of the SJWs.

I think anyone who's that worried about SCOTUS is already expecting RGB to retire/die in Trump's next term. Unless she's replaced before the election, it's going to be an issue. If her replacement is a done deal, Republicans will be eager to vote for more Trump, and to punish the Left for whatever nonsense they cooked up against the new justice. Democrats will be just as triggered as they have been since the 11/9 Trumpist attack of 2016
-
If you want a fun intellectual exercise, imagine the Left's reaction to Ginsburg croaking today. The "impeachment inquiry" is headed nowhere, throw RBG going away on the fire... You're welcome.

Bingo. Offer the dems an olive branch and watch them use it to beat on their own.

The Dems would still claim that “no president facing impeachment should nominate a Supreme Court justice.”

The logical next step would that no president facing impeachment should do anything -- effectively paralyzing the government (or turning it over completely to the nameless, faceless, unelected bureaucracy). The reality is that impeachment is not a conviction, it's the equivalent of a grand jury indictment. Trump has [edit: NOT EVEN] been impeached, and the fundamental rule of American law is that a person is innocent unless proven guilty beyond a reasonable doubt. Ergo: unless and until Trump has been impeached (indicted) and then tried and convicted in the Senate -- he is legally considered to be innocent. So there is no legal or logical basis for claiming that he should not be carrying out the duties of his office.

For that there actually has to be an impeachment. A few hearings where star witnesses didn't witness anything doesn't count.

I am thinking along these lines. Holding SC Nomination hearings would be a good reminder for Republicans as to why they want to vote for Trump. If the Democrats do another underhanded attack like they did for Kavanaugh, it won't help them.
IMO, it would be much WORSE for the Republicans if Ginsberg passes away and they decided to wait. I think a lot of Republicans wouldn't like that. If they have the shot at another SC Justice, take it. Don't wait and hope the election turns out okay. This is a Lifetime appointment.

You’re being way too logical. The same politicians who said “we have to pass it to see what’s in it” and read a fake call transcript wouldn’t hesitate to use any argument if they thought it would keep Trump from picking a new justice.
-
Hm. Good point. So now I wonder if all this fake impeachment BS was engineered to create a "facing impeachment" fuss, thereby precluding or invalidating a replacement nomination by President Trump if Associate Justice Bader passes on.
Or just causing trouble for him.
It might well be in keeping with their "anything --anything at all --to screw Trump" lowlife activities.
Hey, they're diabolically clever, y' know.

The Democrats have held impeachment inquiries into every Republican President over the last five decades or so.

Actually every president since and including Reagan has had some sort of an impeachment hearing. Ford did not have any form of impeachment hearings, so it doesn't expand to every Republican president over the last five decades.

I seem to recall talk at the time of impeaching Ford. So IIRC it was being considered.

Yep, you're right
Only months after Gerald Ford assumed the presidency, Democrats in Congress floated the possibility of impeaching him for cutting a deal with Nixon that traded resignation for a pardon. (This little-remembered effort is recounted in my book, The Class of ’74.)

My personal thought experiment is looking back at past presidents, then attempting to guess at how their terms would have gone if they'd been subjected to the same social media that Trump has been. To a lesser extent Obama, and I think W Bush was probably the early start of social media usurping the 24 hour news cycle.
Remembering the Reagan hate, applied today, the derangement syndrome would have been at least as bad as it is with Trump, IMO.

I remember almost daily warnings about how Reagan was going to start a nuclear war and about how he needed to be remove from office before he could. Look at the sudden explosion (pun!) of The End of the World movies that got produced, The Day After probably being the most famous, after Reagan got elected.
Yes there were TEOTW movies before then but it sure seemed like Hollywood put the petal to the metal on them post 82.

I was in middle/high school during the Reagan era, I do remember constant propaganda about how nuclear war was imminent because of Reagan.
