Well, given what can be transmited through saliva, I'd say that that's assault.  *expletive deleted*it, throw in AIDS and its assault with a deadly weapon, IMHO.

No but, if it were this private citizen the food service attendant would be pretty occupied with trying to find all of his teeth. In other words, the cosmos does balance out resonably well. Spitting on a person is an assault in this state, and I would imagine it is in California as well.

Wow, a loogie will get you a ten year two count fellony.  Anyone else see a problem with losing your 2nd amendment rights over phlem???  A misdimenor, sure, a trip to the county jail for a few day's R&R with bubba?? Absolutely, but there are RAPISTS and MURDERS that don't get ten years!!!

I actually dont think that people should lose their civil rights for commiting crimes. However, i see no reason at all why spitting in a person's food should not be a felony especially considering the chance that one can outright injure a person with god knows what kind of disease. More to the point, the type of person who would commit such an act isnt someone that we want roaming around with the normal people.

Didn't this happen a while back to an officer at a Sonic? Someone spit in his drink, but he caught it when he saw the employees loking at him through the window and laughing. Maybe its the same guy doing the spitting?

It's about the fact that it's a police officer, and that if it were a normal citizen, nothing would happen. Do you really think if you reported some phlegm in your Arby's Wrap, police would take it and do a DNA analysis? No, but police are "special" people.
