Apparently Disney has no problem with Santa Clause, just as long as no one but a Disney employee potrays him.

I could see an issue if the dude was trying to imitate a Disney character, but a monopoly on Santa Clause?!  I can see this one backfiring on them... big time.

I read someplace that the Santa in the red and white suit was actually a creation of Coca Cola.

From the various things I've read, our current picture of Santa Claus comes both from Coca-Cola advertisments and Twas the Night Before Christmas.  But his association with the color red is said to come from the color of bishops' robes.  Saint Nicholas was a 4th-century bishop in what is now Turkey.
