Father Shot 2 Officers Who Mistakenly Served Warrant at His Home

I came across this link off Twitter.  A father fired a shotgun at officers as the forcibly entered his house.  He apparently surrendered immediately upon realizing they were cops.

He wasn't shot and no charges are being brought against him.  As things go, this is a good outcome (for the homeowner) compared to a number of other stories we have posted here.

One officer has been treated and released and another is still undergoing treatment for injuries to their arm and face, police said.

The chief said the department will do a review of all search warrants that are pending and issued a moratorium on search warrants for at least 24 to 48 hours to make sure a similar incident doesn't happen again.

Stawinski also said detectives who worked the case might be disciplined.

"I am not satisfied that we had done enough to corroborate the information we had in the obtaining of that search warrant," he said.
Sounds like some clear thinking leadership in the department.

Make that 24,000 to 48,000 hours and you'll have something there.

I know judges are presented with and go over the affidavits which  support the warrant, so  you really can't get mad at them, but man, I wax vengeful over the officers who generate those affidavits based on thin air and wishful thinking.

Although this apparently wasn't a no-knock since the claim is that they announced themselves before forcing entry, but announcement or not, with home invasions in the news, I would not open my door until I called dispatch to verify an actual police presence out there.

And just waving a badge around won't cut it for me.

I agree that the spokesman seemed to have his head screwed on straight.

"We could be talking about a completely different situation based on what they encountered when they got into that apartment. We are very very relieved tonight that both of our officers are alive," police spokeswoman Jennifer Donelan said after the incident.

Considering that they had a 9-man SWAT team there and they were in the wong place, I think they should be damned relieved that they didn't kill an innocent person. Generally, these days when the police shoot or kill an innocent in the course of "just doing their job," they consider it collateral damage. Well, when officers get shot serving warrants on the wrong place, that seems to be collateral damage, too.

Another officer returned fire, but no one was hit.

Miracle that only one was firing back, I'd say.
I wish the Ring had never come to me. I wish none of this had happened.

So do all who live to see such times. But that is not for them to decide. All we have to decide is what to do with the time that is given to us. There are other forces at work in this world, Frodo, besides the will of evil. Bilbo was meant to find the Ring. In which case, you also were meant to have it. And that is an encouraging thought

Also a good thing the officer who fired back wasn't a good shot. However, that doesn't say much for the SWAT team's training.

Maybe the officer who fired thought he saw the family dog.
