DOJ 2A Task Force withdraws anti-gun position regarding 80% frame or receiver/ "ghost gun":

"As part of implementing the President's Executive Order, the Attorney General on April 8 created the Second Amendment Enforcement Task Force, which is devoted to protecting the Second Amendment rights of all Americans.

Upon review of this case by the Task Force, the government has reconsidered its position in this case.  The government's view is that the Supreme Court's decision in VanDerStok provided some clarity on the regulatory question of how best to apply the Gun Control Act to unfinished frames and receivers, but this interpretation should not serve as a basis for punishing gun manufacturers for conduct that the Bureau of Alcohol, Tobacco, Firearms and Explosives (ATF) considered lawful at the time of the sales.

The government further no longer wishes to be a party to this litigation.  If and when this Court should remand this case to the District Court, the government would move to withdraw as a party to this case."

Miller case was held at 9th Circuit pending Duncan.  Now that en banc ruling has been made on Duncan and headed to the Supreme Court, Miller case is moving forward.

ICYMI: In October of ‘23, the District Court handed us a beautiful decision in our Miller v Bonta CA AWB Lawsuit, plainly stating that so-called “assault weapons” cannot be banned.

After being appealed, the 9th Circuit put the case in purgatory until Duncan v. Bonta, another case from the community challenging mag bans, was decided.

Today, our Miller v. Bonta Lawsuit finally moves forward as supplemental briefs are due with the 9th Circuit in response to the decision in Duncan.

We filed a supplemental brief with the Ninth Circuit today in our lawsuit challenging California's "assault weapon" ban. This Task Force serves as another example of the Trump Administration’s commitment to using all the tools it has available to protect our constitutional liberties. It will create a critical space for the federal government to devise innovative strategies to use litigation and policy effectively in the fight to protect the Second Amendment. We applaud your choice to create it.

The Second Amendment right to keep and bear arms is essential to the preservation of the rest of our liberties. The Supreme Court has recognized the right’s paramount importance in our constitutional structure, explaining that the Second Amendment enshrines a “fundamental” preexisting right “deeply rooted in this Nation’s history and tradition.” But, somehow, courts and other government officials have sometimes not “afford[ed] the Second Amendment the respect due [to] an enumerated constitutional right.”

We saw a particularly troubling animus against the Second Amendment put into action in the last administration. Then, the federal government took drastic actions against gun rights that showed no respect for law-abiding gun owners. The firearms industry, President Biden declared, was the “enemy.” Altogether, federal agencies stretched statutes and ignored facts on their way to trouncing on Second Amendment rights in a variety of contexts.

We States have been fighting back on such sentiments for some time. West Virginia, for instance, has always been among the first states to take the initiative to stand against governmental infringement of the right to keep and bear arms. Just this month, the West Virginia Legislature passed multiple bills aimed at protecting gun rights and the firearms industry. Bills like the FIND Act, the West Virginia Firearm Liability Clarification Act, and the Firearm Industry Nondiscrimination Act aim to strengthen Second Amendment protections by limiting gun control measures and protecting the firearms industry from discrimination by other business entities. These measures complement our efforts before the Supreme Court. There, we have defended an originalist understanding of the Second Amendment and pushed back on the Biden administration’s anti-gun oversteps.

We are heartened to see that the federal government has now rejoined us in our fight for Second Amendment liberties. This Task Force will serve as a key reset of President Biden’s misguided approach and a crucial cornerstone of President Trump’s efforts to restore Second Amendment rights to its rightful place as a first-class liberty.

We recognize the success of this Task Force will be vital. To that end, we promise to use our own resources to support the Task Force and collaborate with this administration in whatever way possible. We will stand beside you in Second Amendment litigation. We will provide administrative expertise as you decide how best to reform federal regulations in this area. Here’s what you need to know:
In a high-profile Second Amendment case (Wolford v. Lopez), the U.S. Department of Justice filed a legal brief urging the Supreme Court to review—and reverse—the Ninth Circuit’s decision that upheld Hawaii’s controversial concealed carry restriction.

What’s the law?
Hawaii makes it a crime (punishable by up to 1 year in jail) for a licensed gun owner to carry a firearm on any private property open to the public (like gas stations, stores, or restaurants) unless the property owner gives express permission, such as posting a sign.

Why is the DOJ opposing it?
According to the DOJ’s brief:
•The law inverts centuries of legal tradition, where people could carry arms unless told otherwise.
•It functionally bans public carry—turning everyday errands into legal minefields for gun owners.
•It targets gun rights, not protects property rights—especially since it exempts police, government employees, and others.

Time for a thread on the amicus brief submitted by the United States (!!!) in Wolford v. Lopez.

To my knowledge, it is the first-ever Supreme Court brief filed by the United States in full support of petitioners challenging a gun law as unconstitutional under the Second Amendment, but someone correct me if I am wrong on that assertion.

Great introduction that goes into the ramifications of the vampire rule. And as our amicus brief will cover, this was intentional. The vampire rule was created by antigun academics who openly stated the aim was to discourage carry.

This is why we insist on calling it the "Vampire Rule" in our briefing, a term invented by @2Aupdates

It is NOT actually a "default" rule, because it is not default for anyone but those carrying with a CCW permit. A whole bunch of other categories of people carrying are exempt. The sudden concern with "private property rights," from people who have never met regulations affecting private property they didn't love, is totally phony.

So shocking that Hawaii, a state which almost never issued CCW permits before it was forced to, is trying to undermine Bruen! 🤣

I wish they didn't include the part about "limited to the first question presented," but they are still the government, and we should be happy to take what we can get.

The second question deals with the 1791 vs. 1868 debate. I don't know why they don't want that settle too; perhaps they like using those later laws to defend certain federal gun laws they do like.

Pocatello, 942 F.2d 635, 639 (9th Cir. 1991) (“Under the Idaho Falls and Pocatello ordinances, residents who wish to receive uninvited door-to-door solicitors must post a ‘Solicitors Welcome’ sign. The government’s imposition of affirmative obligations on the residents’ first amendment rights to receive speech is not permissible.”).

Yes, most of the purported "analogues" only applied to private land NOT held open to the public, and were anti-poaching efforts.

It's still so crazy to me that the Ninth Circuit panel cited a goddamn Black Code to uphold the Vampire Rule, then when given the opportunity to correct that en banc, said "nah."

It was so weird how the panel found the narrowest possible technical grounds to uphold the Hawaii law but not California's version. It would have been so easy to go with what every other court has said, even antigun courts like the Second Circuit, and strike down the vampire rule. It's like they wanted to create a split.

I wish they'd just come out and ask SCOTUS to grant cert in Snope, but I suppose that would be a bit improper given the amicus deadline passed before the new administration began. Still, they walk right up to that line.

Hopefully, they do an amicus brief for Duncan once our cert petition is filed.

The brief concludes by arguing that the Court should not refuse to grant cert because of the interlocutory posture.

Obviously, I strongly agree and I am so glad they said this.

The whole "needing a complete record" is a bullshit excuse to not take a case in the context of constitutional challenges. The facts are rarely in dispute, these are purely LEGAL disagreements. A more "complete record" adds nothing but years of legal expense for nonprofit plaintiffs.
