DOJ 2A Task Force withdraws anti-gun position regarding 80% frame or receiver/ "ghost gun":

"As part of implementing the President's Executive Order, the Attorney General on April 8 created the Second Amendment Enforcement Task Force, which is devoted to protecting the Second Amendment rights of all Americans.

Upon review of this case by the Task Force, the government has reconsidered its position in this case.  The government's view is that the Supreme Court's decision in VanDerStok provided some clarity on the regulatory question of how best to apply the Gun Control Act to unfinished frames and receivers, but this interpretation should not serve as a basis for punishing gun manufacturers for conduct that the Bureau of Alcohol, Tobacco, Firearms and Explosives (ATF) considered lawful at the time of the sales.

The government further no longer wishes to be a party to this litigation.  If and when this Court should remand this case to the District Court, the government would move to withdraw as a party to this case
."

Miller case was held at 9th Circuit pending Duncan.  Now that en banc ruling has been made on Duncan and headed to the Supreme Court, Miller case is moving forward.

ICYMI: In October of ‘23, the District Court handed us a beautiful decision in our Miller v Bonta CA AWB Lawsuit, plainly stating that so-called “assault weapons” cannot be banned.

After being appealed, the 9th Circuit put the case in purgatory until Duncan v. Bonta, another case from the community challenging mag bans, was decided.

Today, our Miller v. Bonta Lawsuit finally moves forward as supplemental briefs are due with the 9th Circuit in response to the decision in Duncan.

We filed a supplemental brief with the Ninth Circuit today in our lawsuit challenging California's "assault weapon" ban. It will create a critical space for the federal government to devise innovative strategies to use litigation and policy effectively in the fight to protect the Second Amendment. The Second Amendment right to keep and bear arms is essential to the preservation of the rest of our liberties. The Supreme Court has recognized the right’s paramount importance in our constitutional structure, explaining that the Second Amendment enshrines a “fundamental” preexisting right “deeply rooted in this Nation’s history and tradition.” But, somehow, courts and other government officials have sometimes not “afford[ed] the Second Amendment the respect due [to] an enumerated constitutional right.”

We saw a particularly troubling animus against the Second Amendment put into action in the last administration. Then, the federal government took drastic actions against gun rights that showed no respect for law-abiding gun owners. The firearms industry, President Biden declared, was the “enemy.” Altogether, federal agencies stretched statutes and ignored facts on their way to trouncing on Second Amendment rights in a variety of contexts.

We States have been fighting back on such sentiments for some time. West Virginia, for instance, has always been among the first states to take the initiative to stand against governmental infringement of the right to keep and bear arms. Just this month, the West Virginia Legislature passed multiple bills aimed at protecting gun rights and the firearms industry. Bills like the FIND Act, the West Virginia Firearm Liability Clarification Act, and the Firearm Industry Nondiscrimination Act aim to strengthen Second Amendment protections by limiting gun control measures and protecting the firearms industry from discrimination by other business entities. These measures complement our efforts before the Supreme Court. There, we have defended an originalist understanding of the Second Amendment and pushed back on the Biden administration’s anti-gun oversteps.

We are heartened to see that the federal government has now rejoined us in our fight for Second Amendment liberties. This Task Force will serve as a key reset of President Biden’s misguided approach and a crucial cornerstone of President Trump’s efforts to restore Second Amendment rights to its rightful place as a first-class liberty.

We recognize the success of this Task Force will be vital. Unfortunately, NC will not get Constitutional Carry.  Not possible with our current governor, and having lost our supermajority in the legislature.  Also, most of the county sheriffs do not want to lose the revenue generated by CCW permits.
If there really was intelligent life on other planets, we'd be sending them foreign aid.

What’s the law?

Time for a thread on the amicus brief submitted by the United States (!!!) in Wolford v. Lopez.

To my knowledge, it is the first-ever Supreme Court brief filed by the United States in full support of petitioners challenging a gun law as unconstitutional under the Second Amendment, but someone correct me if I am wrong on that assertion.

The whole "needing a complete record" is a bullshit excuse to not take a case in the context of constitutional challenges. The facts are rarely in dispute, these are purely LEGAL disagreements. A more "complete record" adds nothing but years of legal expense for nonprofit plaintiffs.
