- The Plum Book ... let's talk about what this means ... Kash Patel ... taking over the ATF how's this possible and how do the dots connect
- I'm in a suit today because I was on Fox News talking about President Trump, DOGE, Elon Musk, the Supreme Court and Kash Patel ... a lot going on in American Life
- What does this mean and is this possible? How might this work?
- Remember I talked to you a couple months ago about The Plum Book?

The Plum Book is that book put out by the United States government with something like 7,000 positions in the federal government that the president of United States has authority to appoint-
Some of those positions are like the head of the EPA or the Department of Commerce, the Department of Justice
- They require the presidential nomination and a senate confirmation hearing and approval
- And some of those are just presidential appointments like Tom Homan, the immigration czar or White House Counsel ... This don't require Senate approval- This just requires the president to do it and there's a lot of other jobs as well and we talked in detail about some of the ways that the president can appoint people at the ATF consistent with The Plum Book, which of course historically has made it very difficult for there to be change in Washington but as you know there's a lot of change going on in Washington
- So let's talk about what does all this have to do with Kash possibly becoming the director of the ATF
- Here's what I think might be happening
- Kash Patel has now been confirmed as the head of the FBI
- The anti-gun groups undeniably hated this idea. If you look at the various social media posts of the various anti-Second Amendment, anti-gun groups in America, they clearly did not like Kash Patel to be the head of the FBI

Kash Patel ... confirmed by the United States Senate ... places him in a very special position because ... that allows you to be able to take a lot of jobs in the federal government- Kash Patel is now in charge of the FBI ... criminal enforcement of federal law
- Department of Justice announced ... they're going to laser focus on violent dangerous individuals, cartel members, terrorists, drug dealers and the like
- Kash Patel is in charge of the FBI and the Department of Justice has announced specifically that
they're going to laser focus on going after dangerous thugs and gang members and the like

So Kash Patel has now been confirmed as the head of the FBI. So how does this connect up to the ATF?
- Kash Patel can now, in addition to being the confirmed director of the FBI, he can now ... I'm not aware of any reason why this cannot occur ... become the acting director of the ATF because acting directors can get appointed for long periods of time when there is a vacancy in these jobs- The idea being with the notion of an acting director of the ATF ... is that
during the time period between a presidential nomination and a Senate confirmation or during a time period when an important governmental slot is vacant, an acting person can be put in charge for a ... temporary period of time that usually last upwards of a year or so-
But what's quite interesting here is there are limits on the time ability of someone to function as an acting head of the ATF ... because the acting person has not been Senate confirmed but here you have Kash Patel who has been presidentially appointed, Senate confirmed to be the FBI director- Now you can put him in the position of effectively the acting director of the ATF

So the question is why might Donald Trump and Pam Bondi want to have Kash Patel running the FBI officially as Senate confirmed and have him function as acting director of the ATF, which he has authority to do because he's Senate confirmed- So he's above all the bureaucrats ... he's above non-bureaucratic, he's above all people except really the president and the vice president in the world of government

This is why we talked about The Plum Book in detail, to understand these rankings which mean nothing to you, mean nothing to me, but mean everything to the bureaucracy and the federal government- So why is this a great idea? Why does this make sense?
- Here's why. Remember I reported on ... about 3 or 4 weeks ago how all of the law enforcement
agents ... who have the power to carry guns, the power to arrest, the power to go on raids, the power to be law enforcement cops ...
All the law enforcement agents working for the ATF were effectively reassigned to engage in ... immigration enforcement but the licensing people, the NFA people, the inspectors kind of the civil side of civil enforcement at the ATF were not reassigned to immigration. They were told to keep functioning and doing what you're doing

What just happened is ATF took all their law enforcement agents that have the ability to do dynamic raids, those agents have now been moved from the ATF ... although they're still ATF employees, they've been moved from the ATF, in effect,
to work for the FBI and others as part of immigration enforcement and going after cartels and violent thugs- But at the same time, the civil components of the ATF ... you know the Firearms Technical Division to make sure whether or not that's a suppressor, that's not a suppressor, that's a short barrel rifle, that's not a short barrel rifle, that's a bump stock ... you know, all that kind of technical stuff that occurs at ATF, that has not been impacted
- But that all civil stuff you don't go to prison per se for the civil side of things ... civil side of things is about civil remedies and making sure you comply with regulations
- And the criminal side of the ATF is about arresting you and putting you in prison
- But all those guys in the criminal side of the ATF have essentially been moved over and are now working with the FBI and other federal law enforcement to enforce the law against, for example, illegal immigrants, the gangs, the cartels and the like

So in many respects if you see what just happened here is Kash Patel by virtue of being the head of the FBI and now the acting director of the ATF is now able to marshall the resources of the ATF, the law enforcement side ATF, and move it over to join the ranks of his FBI officials, his FBI law enforcement agents to go advance the president's agenda of targeting cartels, gangs, violent thugs- That is what's happening here but
that leaves the remnant of the ATF civil enforcement divisions ... NFA licensing, FFL work that's just left behind- I think what may be happening here is that Kash Patel is effectively going to oversee the ATF, and the reason why I hammered home on this point that he's been Senate confirmed ... because the
classic argument against people that become acting directors ... is that they haven't been Senate confirmed ... legal arguments ... all go out the window
- Why?
- Because Kash Patel is Senate confirmed which makes him a special person in the hierarchy of the
federal government
- Again, he's been Senate confirmed and that makes him special in the context of the federal hiring system, the federal bureaucracy and who has legal authority ... to make certain decisions which is a big deal today as you see these ongoing attacks over Elon Musk and DOGE where the argument is they lack legal authority to do what they're doing
- So this argument about legal authority is a very big deal
- And by having Kash Patel be the acting director of the ATF ... really is a great idea because I do
think it will make arguments against his conduct on behalf of the ATF, meaning it's not enforceable or not binding a lot harder, given the fact that he was Senate confirmed
- Reports that are coming out of Washington ... ATF ... Pam Bondi, Donald Trump and Kash Patel over the next few days but in the meantime ... overall I think this is all very good news for our Second Amendment rights
