- Forced Reset Trigger lawsuit
- ATF didn't actually issue an official rule ... they didn't go through the administrative procedures process defining forced reset triggers as machine guns ... they just internally declared it to be so and started enforcing it
- We were able to block it and then we were able to eventually win summary judgment at the District Court
- ATF ... appealed to the 5th Circuit ... deadline is fast coming up [to return the triggers to owners] so the relief deadline to have all of that done by is February [It's already February  =D =D =D]
- ATF asked could we get a ruling in a hurry please because we really need some relief here
- Get that? The ATF is finally asking for relief from the Second Amendment  :rofl: :rofl: :rofl:
- Right ... so the 5th Circuit said okay, we will give you a ruling in a hurry
- So we are expecting 5th Circuit to issue that ruling on our summary judgment win right around the corner sometime in the next couple of weeks
- Oral arguments went really well ... again this is the 5th Circuit ... pretty much the most pro-2A wins we're getting in the federal court system are coming out of the 5th Circuit ... So we expect that ruling to go in our favor
- Then the question is going to be will the ATF keep appealing?
- We're under a new administration, we're under new guidance under the DOJ
- Our own board chairman David Warrington is now the White House Council so it's a new era and we don't exactly know what to expect except that Trump's recent executive order told the DOJ to basically do an audit of all of this stuff right and to come up with a plan for all of it within the next 30 days
- So what we do know is that while the 5th Circuit is getting ready to rule, the Trump administration
is taking a real hard look at whether or not they want to even appeal this case
- I personally would rather see the administration yank all those policies immediately and move out the case and that's for two reasons
- Number one ... our case is not actually based on the Second Amendment ... we're not fighting it under Bruen ... this is an agency powers case that is the case with most of the lawsuits against the ATF over their over their rules ... whether or not the ATF can just unilateral ban them based on current federal statute
- We've already got that ruling on the bump stock issue in Cargill ... we've already got what we need there ... so the precedent that we needed for agency powers is already in place and so there's really nothing to be gained by continuing to litigate ... We got Cargill ... I'd rather just let that stand
- President's ... executive order protecting the Second Amendment ... there's 25 or 24 days left for Pam Bondi and DOJ to strike down whatever they concocted during the Biden administration
- We're ... keeping a very close eye on things ... we're mobilizing our members to encourage Pam Bondi to repeal as much of this junk as possible

In United States v. Veasley, we concluded that keeping firearms out of the hands of drug users does not “always violate the Second Amendment.” (8th Cir. 2024). Now the question is whether it sometimes can. The answer is yes, so we remand for the district court to determine whether it does for LaVance Cooper.

Cooper ... smoked marijuana three to four times a week ... officers found a Glock 20 pistol in his car during a traffic stop ... the district court found Cooper guilty of being a drug user in possession of a firearm, see 18 U.S.C. § 922(g)(3), and sentenced him to 37 months in prison.

In every Second Amendment case, the overarching question is whether a limitation on the right to keep and bear arms is “consistent with this Nation’s historical tradition of firearm regulation.” Bruen ...

Key to answering that question is identifying “analogues”: Founding-era regulations that “impose[d] a comparable burden on the right of armed self-defense” with a “comparabl[e] justifi[cation].” Rahimi ...

If no comparable analogues exist because “disarmament is a [purely] modern solution to a centuries-old problem,” Veasley ... or strays too far from the “how and why” of “historical regulations,” Bruen, then the Second Amendment kicks in. (Page 3)

Did using marijuana make Cooper act like someone who is “both mentally ill and dangerous”? Veasley ... Did he “induce terror,” or “pose a credible threat to the physical safety of others” with a firearm? Rahimi (Page 5)

Nothing in our tradition allows disarmament simply because Cooper belongs to a category of people, drug users, that Congress has categorically deemed dangerous ... The only potential analogue that seemed to apply categorically was intoxication, but disarmament was not the remedy for it. Veasley (Page 6)

... the “outer bounds” of the Second Amendment are always “delimit[ed]” by “historical tradition.” Bruen. From that foundational principle, “the appropriate analysis” necessarily “involves considering whether the challenged regulation ... is ‘relevantly similar’ to laws that our tradition

GOA’s lawsuit challenges Philadelphia’s ordinance that restricts the manufacturing of firearms, components, and attachments for personal use.  We argue that the ban violates Pennsylvania’s preemption statute, the Uniform Firearms Act (UFA), along with infringing Article I, Section 21 of the Pennsylvania Constitution, which guarantees the right to bear arms.

Philadelphia’s ordinance, which prohibits the private manufacturing of firearms through processes like 3D printing or completing unfinished firearm frames, directly contradicts state law, which preempts all local firearm regulations. GOA’s petition argued that the Philly ordinance infringes upon the constitutional right to self-defense and violates the UFA, which gives the General Assembly exclusive power to regulate firearms.

We will now be asking the Pennsylvania Supreme Court to reverse the Commonwealth Court’s decision (which upheld the ordinance), and confirm that the UFA broadly preempts Philadelphia’s ordinance, restoring the uniform protection of the right to keep and bear arms across Pennsylvania.

Erich Pratt, Senior Vice President of GOA, issued the following statement:

“Philadelphia’s efforts to regulate firearm manufacturing go against the core of Pennsylvania’s firearm preemption law and violate the rights of its citizens. With the Pennsylvania Supreme Court now agreeing to hear this case, we are hopeful that Pennsylvanians’ rights will be protected from Philadelphia’s unconstitutional tyranny at the local level.”

So here's where we are at with Forced Reset Triggers. There are a lot of moving parts that extend all the way from the district court to the White House, so the short answer is that we're all in limbo. Explanation thread below.

We won final judgment vacating the rule and ordering the ATF to return NAGR members' seized triggers. ATF got the deadline pushed back to Feb. 22 (tomorrow) and appealed to the 5th Circuit. The 5th agreed to put the case on an expedited schedule.

Meanwhile, though, ATF has been a) refusing to return triggers to NAGR members, and b) trying to limit relief ONLY to members when we filed the lawsuit. We pushed back on both with a contempt motion filed at the district court.

Meanwhile, we had successful oral arguments at the 5th Circuit. We've been expecting the ruling to come sometime before tomorrow, but at this point...who knows. I do think the district court is waiting on that before ruling on our contempt motion.

The scope of relief for FRT owners will very much depend - for the moment - on what the 5th Circuit ends up ruling and what the district court decides on our contempt motion. BUT... There's one more piece - and that's Trump's executive order directing DOJ to review the ATF's policies and every 2A-related item in the entire executive branch. The FRT ban will certainly be discussed in that review.

Regardless of what the courts decide on relief, I'd be shocked if the ATF ultimately hangs onto seized triggers when the determination justifying their seizure has been overturned by the courts, regardless of the owner's NAGR membership status. So while it's a waiting game, there's lots of reason for hope.

- There's a lot of discussion about ... Kash Patel ... becoming director of the ATF
- The Plum Book ... let's talk about what this means ... Kash Patel ... taking over the ATF how's this possible and how do the dots connect
- I'm in a suit today because I was on Fox News talking about President Trump, DOGE, Elon Musk, the Supreme Court and Kash Patel ... a lot going on in American Life
- What does this mean and is this possible? How might this work?
- Remember I talked to you a couple months ago about The Plum Book?
- The Plum Book is that book put out by the United States government with something like 7,000 positions in the federal government that the president of United States has authority to appoint
- Some of those positions are like the head of the EPA or the Department of Commerce, the Department of Justice
- They require the presidential nomination and a senate confirmation hearing and approval
- And some of those are just presidential appointments like Tom Homan, the immigration czar or White House Counsel ... This don't require Senate approval

- This just requires the president to do it and there's a lot of other jobs as well and we talked in detail about some of the ways that the president can appoint people at the ATF consistent with The Plum Book, which of course historically has made it very difficult for there to be change in Washington but as you know there's a lot of change going on in Washington
- So let's talk about what does all this have to do with Kash possibly becoming the director of the ATF
- Here's what I think might be happening
- Kash Patel has now been confirmed as the head of the FBI
- The anti-gun groups undeniably hated this idea.  If you look at the various social media posts of the various anti-Second Amendment, anti-gun groups in America, they clearly did not like Kash Patel to be the head of the FBI
- Kash Patel ... confirmed by the United States Senate ... places him in a very special position because ... that allows you to be able to take a lot of jobs in the federal government
- Kash Patel is now in charge of the FBI ... criminal enforcement of federal law
- Department of Justice announced ... they're going to laser focus on violent dangerous individuals,  cartel members, terrorists, drug dealers and the like
- Kash Patel is in charge of the FBI and the Department of Justice has announced specifically that
they're going to laser focus on going after dangerous thugs and gang members and the like
- So Kash Patel has now been confirmed as the head of the FBI.  So how does this connect up to the ATF?
- Kash Patel can now, in addition to being the confirmed director of the FBI, he can now ... I'm not aware of any reason why this cannot occur ... become the acting director of the ATF because acting directors can get appointed for long periods of time when there is a vacancy in these jobs

- The idea being with the notion of an acting director of the ATF ... is that during the time period between a presidential nomination and a Senate confirmation or during a time period when an important governmental slot is vacant, an acting person can be put in charge for a ... temporary period of time that usually last upwards of a year or so
- But what's quite interesting here is there are limits on the time ability of someone to function as an acting head of the ATF ... because the acting person has not been Senate confirmed but here you have Kash Patel who has been presidentially appointed, Senate confirmed to be the FBI director
- Now you can put him in the position of effectively the acting director of the ATF
- So the question is why might Donald Trump and Pam Bondi want to have Kash Patel running the FBI officially as Senate confirmed and have him function as acting director of the ATF, which he has authority to do because he's Senate confirmed
- So he's above all the bureaucrats ... he's above non-bureaucratic, he's above all people except really the president and the vice president in the world of government
- This is why we talked about The Plum Book in detail, to understand these rankings which mean nothing to you, mean nothing to me, but mean everything to the bureaucracy and the federal government
- So why is this a great idea? Why does this make sense?
- Here's why.  Remember I reported on ... about 3 or 4 weeks ago how all of the law enforcement
agents ... who have the power to carry guns, the power to arrest, the power to go on raids, the power to be law enforcement cops ... All the law enforcement agents working for the ATF were effectively reassigned to engage in ... immigration enforcement but the licensing people, the NFA people, the inspectors kind of the civil side of civil enforcement at the ATF were not reassigned to immigration. They were told to keep functioning and doing what you're doing
- What just happened is ATF took all their law enforcement agents that have the ability to do dynamic raids, those agents have now been moved from the ATF ... although they're still ATF employees, they've been moved from the ATF, in effect, to work for the FBI and others as part of immigration enforcement and going after cartels and violent thugs
- But at the same time, the civil components of the ATF ... you know the Firearms Technical Division to make sure whether or not that's a suppressor, that's not a suppressor, that's a short barrel rifle, that's not a short barrel rifle, that's a bump stock ... you know, all that kind of technical stuff that occurs at ATF, that has not been impacted
- But that all civil stuff you don't go to prison per se for the civil side of things ... civil side of things is about civil remedies and making sure you comply with regulations
- And the criminal side of the ATF is about arresting you and putting you in prison
- But all those guys in the criminal side of the ATF have essentially been moved over and are now working with the FBI and other federal law enforcement to enforce the law against, for example, illegal immigrants, the gangs, the cartels and the like
- So in many respects if you see what just happened here is Kash Patel by virtue of being the head of the FBI and now the acting director of the ATF is now able to marshall the resources of the ATF, the law enforcement side ATF, and move it over to join the ranks of his FBI officials, his FBI law enforcement agents to go advance the president's agenda of targeting cartels, gangs, violent thugs
- That is what's happening here but that leaves the remnant of the ATF civil enforcement divisions ... NFA licensing, FFL work that's just left behind
- I think what may be happening here is that Kash Patel is effectively going to oversee the ATF, and the reason why I hammered home on this point that he's been Senate confirmed ... because the
classic argument against people that become acting directors ... is that they haven't been Senate confirmed ... legal arguments ... all go out the window
- Why?
- Because Kash Patel is Senate confirmed which makes him a special person in the hierarchy of the
federal government
- Again, he's been Senate confirmed and that makes him special in the context of the federal hiring system, the federal bureaucracy and who has legal authority ... to make certain decisions which is a big deal today as you see these ongoing attacks over Elon Musk and DOGE where the argument is they lack legal authority to do what they're doing
- So this argument about legal authority is a very big deal
- And by having Kash Patel be the acting director of the ATF ... really is a great idea because I do
think it will make arguments against his conduct on behalf of the ATF, meaning it's not enforceable or not binding a lot harder, given the fact that he was Senate confirmed
- Reports that are coming out of Washington ... ATF ... Pam Bondi, Donald Trump and Kash Patel over the next few days but in the meantime ... overall I think this is all very good news for our Second Amendment rights

Again, makes little sense to hold onto that interlocutory case just for a dissent from denial of cert, when Thomas and whoever else can say their piece in Snope.

So that gives me some hope still. However, my read could be totally wrong, and it may indeed be as simple as a dissent on both.

Thanks to the hard work and support of our members, we have finally achieved the goal of removing dangerous Gun-Free Zones in K-12 Schools, Colleges, most public buildings, the State Capitol, and most public places in Wyoming!

GOA fought hard to pass this bill in 2022 and 2023, and we ultimately got it over the finish line in 2024, only to have Wyoming Governor Mark Gordon veto it.

Now we have finally been successful in returning Second Amendment Rights that should have never been taken away!

While he did not veto the Legislation, in comments made just before the veto deadline, the Governor did make a number of negative and disturbing comments about the legislation.

One particular comment again cited the concept of “Local Control” and seemed to imply Legislators somehow violated some unwritten law regarding the sanctity of this concept.

As we pointed out last year, in an Op-Ed in Cowboy State Daily (https://cowboystatedaily.com/2024/03/26/letter-to-the-editor-gordon-completely-wrong-on-gun-free-zone-repeal/) there should never be “Local Control of Constitutional Rights.” That is a concept that is very dangerous to our Constitutional Republic.

Fortunately, the majority of the Wyoming Legislature agreed, and GOA wants to extend a heartfelt thank you to the steadfast commitment of Bill Sponsor, Representative Jeremy Haroldson (R – Wheatland), who has worked on this legislation for four years.

The repeal of most of Wyoming’s publicly-funded gun-free zones represents a historic restoration of Second Amendment rights and the end of many areas where only law-abiding citizens have previously been disarmed.
